<br />{{f ~ <br /> <br />-4- <br /> <br />PROPOSITION NO.1 0 <br /> <br />The amendment of Sections 11.01, 11.07 and 11.08 of the City <br />Charter to update and clarify provisions relating to public utility <br />franchises. <br /> <br />Votes for Proposition No. 10: 932 <br />Votes against Proposition No. 10: 145 <br /> <br />PROPOSITION NO. 11 <br /> <br />The amendment of Section 11.11 of the City Charter to update and <br />clarify City Council authority over City-owned utilities. <br /> <br />Votes for Proposition No. 11: 935 <br />Votes against Proposition No. 11: 153 <br /> <br />PROPOSITION NO. 12 <br /> <br />The lease of the Soccer Complex, 9.48 acres, at Gary Park to the San <br />Marcos Youth Soccer Association under terms summarized as <br />follows: <br /> <br />1. Term: 5 years, with two 5-year renewal options subject to City <br />Council approval. <br /> <br /> <br />2. Rights granted: Exclusive right to Concession Building; right of <br />first priority to use remainder of Complex from September 1 st <br />to December 31 st each year. <br /> <br />3. Maintenance: utilities: Soccer Association maintains grounds <br />from September-December; City maintains the rest of the year; <br />City provides water, sewer and electricity. <br /> <br />4. Nondiscrimination: Soccer Association is not to discriminate on <br />basis of religion, race, sex, disability or national origin. <br /> <br />5. Insurance and indemnity: Soccer Association will maintain <br />liability insurance, and will indemnify City for claims and losses <br />connected with Soccer Association's use of Complex. <br /> <br />6. Termination: Soccer Association can terminate with six months <br />notice; City can terminate for default with 60 days notice; City <br />can terminate for any reason with 18 months notice, with City <br />to reimburse Association for permanent improvements at 75% <br />of appraised value during first 5-year term, and 50% of <br />appraised value during second 5-year term, and no <br />reimbursement during the third 5-year term. <br /> <br />Votes for Proposition No. 12: 673 <br />Votes against Proposition No. 12: -.1.;ll <br /> <br />SECTION 4.
