'. . <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br /> SAN MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING <br /> MAP OF THE CITY BY REZONING AN 18.2 ACRE TRACT <br /> OF PROPERTY LOCATED IN THE 500 BLOCK OF WONDER <br /> WORLD DRIVE FROM "PO" PRE-DEVELOPMENT DISTRICT. <br /> TO "R-2" SINGLE-FAMILY DWELLING DISTRICT (MEDIUM <br />I DENSITY); INCLUDING PROCEDURAL PROVISIONS; AND <br /> PROVIDING FOR PENAL TIES. <br /> RECITALS: <br /> 1. On March 26, 1996, the Planning and Zoning Commission of the City of San <br /> Marcos held a public hearing regarding a request to change the zoning from "PO" Pre- <br /> Development District to "R-2" Single-Family Dwelling District (Medium Density) for an 18.2 <br /> acre tract of property located in the 500 Block of Wonder World Drive. <br /> 2. Subsequent to the public hearing on that date, the Planning and Zoning <br /> Commission did, on March 26, 1996 consider and vote to approve the request, and has <br /> recommended that the request be approved by the City Council of the City. <br /> . <br /> 3. The City Council held a public hearing on the 13th day of <br /> May , 1996, regarding the request. <br /> 4. All requirements of Chapter 114, Zoning, of the San Marcos City Code pertaining <br /> to zoning map amendments have been met. <br /> 5. The City Council hereby finds and determines that the adoption of the following <br /> ordinance is in the interest of the public health, morals, welfare and safety. <br />- BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> SECTION 1. The Official Zoning Map of the City, as described in Section 114.029 <br /> of the San Marcos City Code, is amended to rezone the following real property which is <br /> presently zoned "PO" Pre-Development District to "R-2" Single-Family Dwelljng District <br /> (Medium Density): <br /> Street address: 500 Block of Wonder World Drive. <br /> Size: 18.2 acres. <br /> Legal description: See attached Exhibit A. <br /> Deed or plat reference: Volume 365, page 824, Hays County Deed Records. <br /> SECTION 2. The Future Land Use Plan of the San Marcos Horizons City Master <br /> Plan is revised to conform to this zoning map amendment. <br /> SECTION 3. Any person violating any provision of this ordinance shall be deemed <br /> guilty of a misdemeanor and upon conviction shall be subject to the penalty provided in <br /> Section 1.015 of the San Marcos City Code. <br /> SECTION 4. After its original passage, this ordinance will be subject to <br /> reconsideration at the next regular City Council meeting. If this ordinance is not <br /> reconsidered, or if it is reconsidered and approved, notice of its adoption will be published <br /> in a newspaper of general circulation in the City. This ordinance will take effect upon <br /> publication of this notice. <br />
