<br /> 9£ <br /> ORDINANCE NO. - <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS, AUTHORIZING THE ISSUANCE AND SALE OF CITY OF SAN MARCOS, <br /> TEXAS, WATERWORKS AND SEWER SYSTEM REVENUE BONDS, SERIES 1996, <br /> IN THE AGGREGATE PRINCIPAL AMOUNT OF $7,500,000; PRESCRIBING THE <br /> FORM OF SAID BONDS; PROVIDING FOR THE SECURITY FORAND PAYMENT <br /> - OF SAID BONDS; AWARDING THE SALE THEREOF; APPROVING THE <br /> OFFICIAL STATEMENT; ENACTING OTHER PROVISIONS RELATING TO THE <br /> SUBJECT; AND DECLARING AN EMERGENCY <br /> I <br /> , <br /> I <br /> WHEREAS, this City Council (the "City Council"), by resolution adopted on April 8, 1996, directed <br /> publication of notice of the intention of the City of San Marcos, Texas (the "City") to issue not to exceed <br /> $7,500,000 waterworks and sewer system revenue bonds of the City for the purposes set forth in such notice; <br /> WHEREA$,. such notice was published in the manner and to the extent required by law; <br /> WHEREAS, there has not been fIled with the City Secretary or any other office of the City a petition <br /> protesting the issuance of such revenue bonds and requesting an election on same; and <br /> WHEREAS, it is affirmatively found and detennined that the City is authorized to proceed with the <br /> issuance and sale of such revenue bonds as authorized by the laws of the State of Texas, including, particularly, <br /> Tex. Rev. Civ. Stat. Ann. arts. 2368a and 1111, et seq.; Now, Therefore . <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS: <br /> ARTICLE I <br /> DEFINITIONS AND OTHER PRELIMINARY MATTERS <br /> Section 1.01. Definitions. <br /> Unless otherwise expressly provided or unless the co~text clearly requires otherwise, in this Ordinance <br /> the follmving terms shall have the meanings specified below: <br /> "Additional Parity Obligations" means those obligations the City reserves the right to issue on a parity <br /> \Vi:th the Bonds, herein authorized in accordance with the tenns and conditions prescribed in Section 9.01 hereof. <br /> "Bond" means any of the Bonds. <br /> "Bonds" means the City's bonds entitled "City of San Marcos, Texas, Waterworks and Sewer System <br /> Revenue Bonds, Series 1996" authorized to be issued by Section 3.01 of this Ordinance. <br /> "Closing Date"-means the date of the initial delivery of and payment for the Bonds. <br /> "Code" means the Intemal Revenue Code of 1986, as amended, including applicable regulations, <br /> published rulings and court decisions relating thereto. <br /> I\:""-'<>lAAIWW"""""""""RDN=>N <br />
