'!;;..d ~ <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING SECTION 110.084 OF THE CITY CODE TO <br />DECREASE THE MINIMUM WIDTH OF SIDEWALKS FOR LOTS OTHER <br />THAN SINGLE-FAMILY AND TWO-FAMILY RESIDENTIAL LOTS FROM <br />SIX FEET TO FIVE FEET; INCLUDING PROCEDURAL PROVISIONS; AND <br />PROVIDING FOR PENALTIES. <br /> <br />RECITALS: <br /> <br />1. The Planning and Zoning Commission conducted a public hearing on <br />February 13, 1996 and has recommended an amendment to the City Code Subdivision <br />Chapter to decrease the minimum width of sidewalks for lots other than single-family and <br />two-family residential lots. <br /> <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. Section 11 O.O84(b)(2) of the City Code is amended to read as follows: <br />< <br /> <br /> <br />(2) Sidewalks on all single-family and two-family residential lots <br />shall be a minimum of four feet in width. Sidewalks on all other <br />lots shall be a minimum of five feet in width. <br /> <br />SECTION 2. All ordinances and resolutions or parts of ordinances or resolutions <br />in conflict with this ordinance are repealed. <br /> <br />SECTION 3. Any person violating any provision of this ordinance commits a <br />misdemeanor and is subject to the penalty provided in Section 1.015 of the San Marcos <br />City Code upon conviction. <br /> <br />SECTION 4. If any word, phrase, clause, sentence, or paragraph of this ordinance <br />is held to be unconstitutional or invalid by a court of competent jurisdiction, the other <br />provisions of this ordinance will continue in force if they can be given effect without the <br />invalid portion. <br /> <br />SECTION 5.
