RESOLUTION 1996- 7.7 R <br /> -- <br /> A RESOLUTION OF THE CITY CgUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS, APPROVING THE USE OF A 5.5 ACRE TRACT <br /> OF CITY PARK PROPERTY FOR THE CONSTRUCTION OF AN <br /> ACTIVITY CENTER; AND DECLARING AN EFFECTIVE DATE. <br /> RECITALS: <br /> 1. The City Council has conducted a public hearing on the proposed use 'Of a 5.5 acre <br /> tract of City park property adjacent to the San Marcos Public Library for the construction <br /> of an activity center. <br /> 2. This public hearing was preceded by notice as required by Section 26.003 of the <br /> Texas Parks and Wildlife Code. <br /> 3. The use of a portion of Memorial Park for this purpose has widespread community <br /> support, as evidenced by the public referendum in May, 1994 in which the proposed <br /> activity center use was approved by 58% of the voters. <br /> 4. The City's architectural consultants for the activity center project have developed <br /> a site plan which will minimize the activity center's impact on the surrounding park land. <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN'MARCOS: <br /> Part 1. That the City Council determines that there is no feasible and prudent <br /> alternative to the use of the 5.5 acre site adjacent to the San Marcos Public Library in <br /> Memorial Park for the construction of the new activity center. <br /> Part 2. That the proposed activity center project includes all reasonable planning <br /> to minimize harm to the land as a park resulting from the project. <br /> Part 3. That the use of the 5.5 acre tract of Memorial Park adjacent to the San <br /> Marcos Public Library for the construction of the proposed activity center project is hereby <br /> approved. <br /> Part 4.
