RESOLUTION 1996- 7.7 R -- A RESOLUTION OF THE CITY CgUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING THE USE OF A 5.5 ACRE TRACT OF CITY PARK PROPERTY FOR THE CONSTRUCTION OF AN ACTIVITY CENTER; AND DECLARING AN EFFECTIVE DATE. RECITALS: 1. The City Council has conducted a public hearing on the proposed use 'Of a 5.5 acre tract of City park property adjacent to the San Marcos Public Library for the construction of an activity center. 2. This public hearing was preceded by notice as required by Section 26.003 of the Texas Parks and Wildlife Code. 3. The use of a portion of Memorial Park for this purpose has widespread community support, as evidenced by the public referendum in May, 1994 in which the proposed activity center use was approved by 58% of the voters. 4. The City's architectural consultants for the activity center project have developed a site plan which will minimize the activity center's impact on the surrounding park land. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN'MARCOS: Part 1. That the City Council determines that there is no feasible and prudent alternative to the use of the 5.5 acre site adjacent to the San Marcos Public Library in Memorial Park for the construction of the new activity center. Part 2. That the proposed activity center project includes all reasonable planning to minimize harm to the land as a park resulting from the project. Part 3. That the use of the 5.5 acre tract of Memorial Park adjacent to the San Marcos Public Library for the construction of the proposed activity center project is hereby approved. Part 4.
