<br /> JcA <br />Sec. 86.151. Adoption of Rules. - <br />(a) The On-site Sewage Facility Rules are adopted, and all officials and employees of <br />the city having duties under these Rules are authorized to perform those duties. <br />(b) It is unlawful for any person who owns, maintains or occupies any structure <br />discharging sewage into an on-site sewage facility within the city to fail or refuse to comply with the <br />On-site Sewage Facility Rules. <br />Sec. 86.152. Sewer connection required. -. <br />(a) It is unlawful for any person to cause or allow the installation of an on-site sewage <br />facility on a tract of property when any part of the property is within 300 feet in horizontal distance <br />(measured on the closest practicable access route) of an existing organized system. <br />(b) Whenever an organized system is developed or extended within 300 feet in <br />horizontal distance from a tract of property served by an on-site sewage facility, it is unlawful for the <br />owner or occupant of the property to fail or refuse to connect the uses served by the on-site sewage <br />facility to the organized system. <br />(c) It is a defense to prosecution of a person under subsection (a) or (b) that: <br /> (1) The person has received a written denial of service from the organized <br /> system; <br /> (2) The person has received a written determination from the organized system <br /> that it is not feasible for the person to connect to the organized system; or <br /> (3) A sewer line connection to the organized system could not operate by gravity <br /> flow. <br />(d) Connection of uses to the organized system shall be made in the most direct manner <br />practicable, and a separate connection to the system is required for each building. <br />(e) The owner of a tract of property is responsible for all costs of connecting the property <br />to the organized system. . <br />(f) It is unlawful for any person to use or maintain a cesspool or pit privy. <br />Sec. 86.153 Duties and powers of the Department. <br />The Department is the designated representative for the enforcement of this division within <br />the city. The Department has the following duties and powers: <br />(1) To resolve any question regarding interpretation of the On-site Sewage Facility <br /> Rules. <br />(2) To enforce the Rules and to make appropriate recommendations to proper city <br /> officials when instances of noncompliance with the Rules have been determined. <br />(3) To make inspections of proposed, new and existing on-site sewage facilities. <br />(4) To collect fees set by the city council to recover the reasonable costs incurred in <br /> administering and enforcing the Rules. <br />(5) To make semi-annual reports to the TNRCC on all actions, including legal actions, <br /> taken concerning these Rules. <br />(6) To investigate nuisance complaints within 21 days of receipt and to resolve or make <br /> substantial progress toward resolving validated complaints within 30 calendar days. <br />(7) To perform all other duties necessary to meet the requirements of the Rules. <br />Persons aggrieved by an action or decision of the Department may appeal the action or <br />decision to the City Council. <br />Sec. 86.154. Permit required to install on-site sewage facility; fees. <br />(2) It is unlawful for a person to cause or allow the installation of an on-site sewage <br />
