<br /> 8.3 Indemnity:
<br /> A. Lessees shall hold harmless, indemnify and defend Lessor, its officers,
<br /> agents and employees from and against all suits, actions, damages, liability and
<br /> expense for loss of life, personal injury or property damage occasioned wholly or
<br /> in part by any act or omission of Lessees, their agents, contractors, employees,
<br /> r- servants, inYitees, licensees or concessionaires, in their use of the Leased
<br /> Premises, the runways and taxi-ways and any other area within the Airport.
<br /> S. Lessees shall store their property in, and shall occupy and use the Leased
<br /> Premises and all other portions of the Airport at their own risk, and Lessees release
<br /> Lessor, to the full extent permitted by law, from all claims of every kind resulting in
<br /> 1055 of life, personal or bodily injury or property damage, including those caused by
<br /> the negligence of the Lessor, its officers, agents and employees.
<br /> C. Lessor shall not be responsible or liable at any time for any 1055 or damage
<br /> of Lessees' fixtures, machinery, airplane(s) or other personal property of Lessees.
<br /> D. Lessor shall not be responsible or liable to Lessees or to those c~aiming
<br /> by, through, or under Lessees for any personal injury or properfy damage that may
<br /> be occasioned by or through the acts or omissions of persons occupying adjacent,
<br /> connecting, or adjoining premises.
<br /> E. Lessor shall not be responsible or liable for any defect, latent or otherwise,
<br /> in any building, equipment, machinery, utilities, appliances, or apparatus at the
<br /> Airport, nor shall Lessor be responsible or liable for any injury, 1055 or damage to
<br /> any person or to any property of Lessees or any other person caused by or
<br /> resulting from any bursting, breakage of or from leakage from pipes, or from water,
<br /> -- - -sewage, steam, snow, or ice, running, backing up, or overflowing in any part of the
<br /> Leased Premises, or from any injury or damage caused by or resulting from any
<br /> defects or negligence in the occupancy, construction, operation or use of any of the
<br /> buildings, equipment, machinery, utilities, appliances or apparatus at the Airport by
<br /> any person or by or from the acts or negligence of any occupant of the premises.
<br /> F. Lessees shall give prompt notice to Lessor in case of accident in the Leased
<br /> Premises or of defects in the runways, taxi-ways, lighting systems or ot~er Airport
<br /> equipment or operations of which Lessees may be aware.
<br /> G. In case Lessor is made a party to any litigation commenced by or against
<br /> Lessees, then Lessees shall protect and hold Lessor harmless and shall pay all of
<br /> Lessor's costs, expenses and reasonable attorney's fees.
<br /> 8.4 Condemnation:
<br /> A. Total: If the whole of the Leased Premises shall be acquired or taken by
<br /> eminent domain for any public or quasi-public use or purpose, then this Lease shall
<br /> cease and terminate as of the date of title vesting in the acquiring entity.
<br /> B. Partial: If any part of the Leased Premises shall be taken or condemned, and
<br /> the partial taking renders that portion of the Leased Premises not so taken
<br /> ~- unsuitable for use by the Lessees, then this Lease and the term in this Lease shall
<br /> cease and terminate. If the partial taking is not extensive enough to render the
<br /> premises unsuitable for use by the Lessees, then this Lease shall continue in
<br /> effect except that the minimum rental shall be reduced and adjusted in an
<br /> appropriate manner.
<br /> C. If this Lease is terminated as provided in this section, rent shall be paid up
<br /> to the date that possession is taken by the acquiring entity, and Lessor shall make
<br /> an equitable refund of any rent paid by Lessees in advance.
