<br />~ <br />~ (J :::- :~ <br />n ~ () '~ ¿ 57 <br />~~ - -'" <br />illS: - i:!:!;S <br />~"" . -' ~ ¡::: <br />..Jgj ~. - ~~ <br />¡>=. ~ >- u;¡ "5 <br />\~~ ~ 5~ ORDINANCE 1 9~6- 44 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING <br />MAP OF THE CITY BY REZONING A 4.557 ACRE TRACT OF <br />PROPERTY LOCATED AT 1010 RIVER ROAD FROM "PO" <br />PRE-DEVELOPMENT DISTRICT TO "MH" MOBILE HOME, <br />DISTRICT; INCLUDING PROCEDURAL PROVISIONS; AND <br />- PROVIDING FOR PENALTIES. <br /> <br />RECITALS: <br /> <br />1. On April 9, 1996, the Planning and Zoning Commission of the City of San Marcos <br />held a public hearing regarding a request to change the zoning from "PO" Pre- <br />Development District to "MH" Mobile Home District for a 4.557 acre tract of property <br />located at 1 01 0 River Road. <br /> <br />2. Subsequent to the public hearing on that date, the Planning and Zoning <br />Commission did, on April 9, 1996 consider and vote to approve the request, and has <br />recommended that the request be approved by the City Council of the City. <br /> <br /> <br />{ <br />3. The City Council held a public hearing on the 10th day of <br />June , 1996, regarding the request. - <br /> <br />4. All requirements of Chapter 114, Zoning, of the San Marcos City Code pertaining <br />to zoning map amendments have been met. <br /> <br />5. The City Council hereby finds and determines that the adoption of the following <br />ordinance is in the interest of the public health, morals, welfare and safety. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. The Official Zoning Map of the City, as described in Section 114.029 <br />of the San Marcos City Code, is amended to rezone the following real property which is <br />presently zoned "PO" Pre-Development District to "MH" Mobile Home District: <br /> <br />Street address: 1 01 0 River Road <br /> <br />Size: 4.557 acres. <br /> <br />Legal description: See attached Exhibit A. <br /> <br />Deed or plat reference: Volume 233, pages 239-241, Hays County Deed Records. <br /> <br />SECTION 2. The Future Land Use Plan of the San Marcos Horizons City Master <br />Plan is revised to change the portion of the property described in Section 1 above that <br />is located outside the floodway area for the Blanco River on the City's flood hazard <br />boundary maps from Open Space/Floodplain to High Density Residential. <br /> <br />SECTION 3. Any person violating any provision of this ordinance shall be deemed <br />guilty of a misdemeanor and upon conviction shall be subject to the penalty provided in <br />Section 1.015 of the San Marcos City Code. <br /> <br />SECTION 4. After its original passage, this ordinance will be subject to <br />reconsideration at the next regular City Council meeting. If this ordinance is not <br />reconsidered, or if it is reconsidered and approved, notice of its adoption will be published <br />in a newspaper of general circulation in the City. This ordinance will take effect upon <br />publication of this notice. <br />
