<br />-3 <br />¿ 0- >-,,", <br />t""\ ~ ~:::: 76 <br />u "C3 - ,- .'"" <br />j tj E .t. --..! :;g¿ <br />Y..i,-,- -= <br />~ J --:;> c:; "" <br />,=- 0- ~:: <br />, 0->. - . - <br /> <br />'~; -- Ë_; ORDINANCE 1§96- 46 <br />~ ~ ~'" <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING <br />MAP OF THE CITY BY REZONING A 146.95 ACRE TRACT <br />OF PROPERTY LOCATED IN THE 2300, 2400 AND 2500 <br />BLOCKS OF HUNTER ROAD FROM "POD" PLANNED <br />DEVELOPMENT DISTRICT TO THE FOLLOWING: 118.68 <br />ACRES TO "R-1" SINGLE-FAMILY DWELLING DISTRICT <br />(LOW DENSITY), 7.79 ACRES TO "MF-4" MULTI-FAMILY <br />DISTRICT (HIGH DENSITY), AND 20.48 ACRES TO "c" <br />COMMERCIAL DISTRICT; INCLUDING PROCEDURAL <br />PROVISIONS; AND PROVIDING FOR PENALTIES. <br /> <br />RECITALS: <br /> <br />1. On May 14, 1996, the Planning and Zoning Commission of the City of San <br />Marcos held a public hearing regarding a request to change the zoning for a 146.95 acre <br />tract of property located in the 2300, 2400 and 2500 blocks of Hunter Road from "POD" <br />Planned Development District to the following: 118.68 acres to "R-1" Single-Family <br />Dwelling District (Low Density), 7.79 acres to "MF-4" Multi-Family District (High Density), <br />.. <br />and 20.48 acres to "C" Commercial District. <br /> <br />2. Subsequent to the public hearing on that date, the Planning and Zoning <br />Commission did, on May 14, 1996 consider and vote to approve the request, and has <br />recommended that the request be approved by the City Council of the City. <br /> <br />3. The City Council held a public hearing on the 24th day of <br />June , 1996, regarding the request. <br /> <br />4. All requirements of Chapter 114, Zoning, of the San Marcos City Code pertaining <br />to zoning map amendments have been met. <br /> <br />5. The City Council hereby finds and determines that the adoption of the following <br />ordinance is in the interest of the public health, morals, welfare and safety. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN. MARCOS, <br />TEXAS: <br /> <br />SECTION 1. The Official Zoning Map of the City, as described in Section 114.029 <br />of the San Marcos City Code, is amended to rezone the following real property which is <br />presently zoned "POD" Planned Development District to the following respective zoning <br />districts: <br /> <br />TRACT 1- To "R-1" Single-Family Dwelling District (Low Density): <br /> <br />Street address: 2300 Block of Hunter Road, and off of Hunter Road between <br />Stagecoach Road and Foxtail Run. <br /> <br />Size: 118.68 acres. <br /> <br />Legal description: J. M. Veramendi Survey No.1, a metes and bounds description <br />of which is attached as Exhibit A. <br /> <br />Deed or plat reference: Volume 753, pages 689 and 697, Hays County Deed <br />Records. <br /> <br />TRACT 2- To "MF-4" Multi-Family District (High Density): <br /> <br />Street address: 2500 Block of Hunter Road. <br />
