J ". ::Z. v3 .~ <br />i:~ i1 56 ORDINANCE 1996--.11 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING <br />MAP OF THE CITY BY REZONING A 11.25 ACRE TRACT <br />OF PROPERTY LOCATED IN THE 1800 AND 1900 BLOCKS <br />OF AQUARENA SPRINGS DRIVE FROM "PD" PRE- <br />DEVELOPMENT DISTRICT AND "u" UGHT INDUSTRIAL <br />DISTRICT TO "MF-5" MULTI-FAMILY DISTRICT (HIGH <br />DENSITY) ; INCLUDING PROCEDURAL PROVISIONS; AND <br />PROVIDING FOR PENALTIES. <br /> <br />RECITALS: <br /> <br />1. On M~y 23, 1996, the Planning and Zoning Commission of the City of San <br />Marcos held a public hearing regarding a request to change the zoning from "PO" Pre- <br />Development District and "u" Light Industrial District to "MF-5" Multi-Family District (High <br />Density) for a 11.25 acre tract of property located in the 1800 and 1 900 Blocks of <br />Aquarena Springs Drive. <br /> <br />2. Subsequent to the public hearing on that date, the Planning and Zoning <br />Commission did, on May 23, 1996 consider and vote to approve ttie request, and has <br />recommended that the request be approved by the City Council of the City. <br /> <br />3. The City Council held a public hearing on the 24th day of <br />June , 1996, regarding the request. <br /> <br />4. All requirements of Chapter 114, Zoning, of the San Marcos City Code pertaining <br />to zoning map amendments have been met. <br /> <br />5. The City Council hereby finds and determines that the adoption of the following <br />ordinance is in the interest of the public health, morals, welfare and safety. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. The Official Zoning Map of the City, as described in Section 114.029 <br />of the San Marcos City Code, is amended to rezone the following real property which is <br />presently zoned "PO" Pre-Development District and "u" Light Industrial District to "MF-5" <br />Multi-Family District (High Density): <br /> <br />Street address: 1800 and 1 900 Blocks of Aquarena Springs Drive. <br /> <br />Size: 11.25 acres (Tracts 1 and 2 combined). <br /> <br />Legal description: Tract 1: Lot 2, Block A, Interpark East, Section 4; Tract 2: 7.958 <br />acres, more or less, of land in the J.M. Veramendi League, Survey No.2, as <br />described in the metes and bounds description of which is attached as Exhibit A. <br /> <br />Deed or plat reference: Tract 1: Volume 4, pages 303 and 304, Hays County Plat <br />Records; Tract 2: Volume 163, page 82, and Volume 141, page 609, and Volume <br />331, page 472, all in the Hays County Deed Records. <br /> <br /> <br />SECTION 2. Any person violating any provision of this ordinance shall be deemed <br />guilty of a misdemeanor and upon conviction shall be subject to the penalty provided in <br />Section 1.015 of the San Marcos City Code. <br /> <br />SECTION 3.
