'.11 vJ -- ..I ~ -- ." . - -- ~ ORDINANCE 1996- 4 q t,,- =::::- ~-...:s AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING A 4.14 ACRE TRACT OF PROPERTY LOCATED AT 1200 AQUARENA SPRINGS DRIVE FROM "M" SINGLE-FAMILY, DUPLEX AND NEIGHBORHOOD BUSINESS DISTRICT TO "MF-4" MUL TI- FAMILY DISTRICT (HIGH DENSITY); INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR PENAL TIES. RECITALS: 1. On May 23, 1996, the Planning and Zoning Commission of the City of San Marcos held a public hearing regarding a request to change the zoning from "M" Single- Family, Duplex and Neighborhood Business District to "MF-4" Multi-Family District (High Density) for a 4.14 acre tract of property located at 1200 Aquarena Springs Drive. 2. Subsequent to the public hearing on that date, the Planning and Zoning Commission did, on May 23, 1996 consider and vote to approve the request, and has recommended that the request be approved by the City Council of the City. 3. The City Council held a public hearing on the 2 4t~ day of June , 1996, regarding the request. 4. All requirements of Chapter 114, Zoning, of the San Marcos City Code pertaining to zoning map amendments have been met. 5. The City Council hereby finds and determines that the adoption of the following ordinance is in the interest of the public health, morals, welfare and safety. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. The Official Zoning Map of the City, as described in Section 114.029 of the San Marcos City Code, is amended to rezone the following real property which is presently zoned "M" Single-Family, Duplex and Neighborhood Business District to "MF-4" Multi-Family District (High Density): Street address: 1200 Aquarena Springs Drive Size: 4.14 acres. Legal description: J.M. Veramendi Survey #2, a metes and bounds description of which is attached as Exhibit A. Deed or plat reference: Volume 295, page 476, Hays County Deed Records. SECTION 2. The Future Land Use Plan of the San Marcos Horizons City Master Plan is revised to conform to this zoning map amendment. SECTION 3. Any person violating any provision of this ordinance shall be deemed guilty of a misdemeanor and upon conviction shall be subject to the penalty provided in Section 1.015 of the San Marcos City Code. SECTION 4. After its original passage, this ordinance will be subject to reconsideration at the next regular City Council meeting. If this ordinance is not reconsidered, or if it is reconsidered and approved, notice of its adoption will be published in a newspaper of general circulation in the City.
