<br />~ ~ 7Q <br />...""" a- -' <br />, ..J 4 .Q:. <br />'.11 <br />vJ -- <br />..I ~ -- ." <br />. - -- ~ ORDINANCE 1996- 4 q <br />t,,- =::::- <br />~-...:s <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING <br />MAP OF THE CITY BY REZONING A 4.14 ACRE TRACT OF <br />PROPERTY LOCATED AT 1200 AQUARENA SPRINGS <br />DRIVE FROM "M" SINGLE-FAMILY, DUPLEX AND <br />NEIGHBORHOOD BUSINESS DISTRICT TO "MF-4" MUL TI- <br />FAMILY DISTRICT (HIGH DENSITY); INCLUDING <br />PROCEDURAL PROVISIONS; AND PROVIDING FOR <br />PENAL TIES. <br /> <br />RECITALS: <br /> <br />1. On May 23, 1996, the Planning and Zoning Commission of the City of San <br />Marcos held a public hearing regarding a request to change the zoning from "M" Single- <br />Family, Duplex and Neighborhood Business District to "MF-4" Multi-Family District (High <br />Density) for a 4.14 acre tract of property located at 1200 Aquarena Springs Drive. <br /> <br />2. Subsequent to the public hearing on that date, the Planning and Zoning <br />Commission did, on May 23, 1996 consider and vote to approve the request, and has <br />recommended that the request be approved by the City Council of the City. <br /> <br />3. The City Council held a public hearing on the 2 4t~ day of <br />June , 1996, regarding the request. <br /> <br />4. All requirements of Chapter 114, Zoning, of the San Marcos City Code pertaining <br />to zoning map amendments have been met. <br /> <br />5. The City Council hereby finds and determines that the adoption of the following <br />ordinance is in the interest of the public health, morals, welfare and safety. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. The Official Zoning Map of the City, as described in Section 114.029 <br />of the San Marcos City Code, is amended to rezone the following real property which is <br />presently zoned "M" Single-Family, Duplex and Neighborhood Business District to "MF-4" <br />Multi-Family District (High Density): <br /> <br />Street address: 1200 Aquarena Springs Drive <br /> <br />Size: 4.14 acres. <br /> <br />Legal description: J.M. Veramendi Survey #2, a metes and bounds description of <br />which is attached as Exhibit A. <br /> <br />Deed or plat reference: Volume 295, page 476, Hays County Deed Records. <br /> <br />SECTION 2. The Future Land Use Plan of the San Marcos Horizons City Master <br />Plan is revised to conform to this zoning map amendment. <br /> <br />SECTION 3. Any person violating any provision of this ordinance shall be deemed <br />guilty of a misdemeanor and upon conviction shall be subject to the penalty provided in <br />Section 1.015 of the San Marcos City Code. <br /> <br />SECTION 4. After its original passage, this ordinance will be subject to <br />reconsideration at the next regular City Council meeting. If this ordinance is not <br />reconsidered, or if it is reconsidered and approved, notice of its adoption will be published <br />in a newspaper of general circulation in the City.
