<br /> - <br /> 101 <br /> STATE OF TEXAS § <br /> § - <br /> COUNTY OF COMAL § <br /> LEASE AGREEMENT <br /> THIS AGREEMENT is made and entered into this 24TH day of June, 1996, by <br /> and between AUSTIN PROPERTY MANAGEMENT, of Travis County, Texas, whose <br /> address is 917 West Anderson Lane #A, Austin, Texas 78757, hereinafter called "Lessor," <br /> and the City of San Marcos WIC Program, whose address is 630 East Hopkins Street, <br /> San Marcos, Hays County, Texas 78666, hereinafter called "Lessee." <br /> NOW THEREFORE, in consideration of the rents to be paid and the mutual' <br /> convenants to be performed, the parties agree as follows: <br /> 1. DESCRIPTION OF LEASED PREMISES: Lessor leases and demises to Lessee <br /> approximately '1,000 square feet of office space located within real property and <br /> improvements situated in New Braunfels, Texas, 78130 with the address of 1551 North <br /> Walnut Street, Suite 2. <br /> 2. TERM: The Lessor agrees, and does lease the premises to the Lessee <br /> beginnning on June 1, 1996 and terminating on September 30, 1996. <br /> . <br /> 3. RENEWALS: Lessee shall, by giving written notice to the Lessor on or before <br /> the sixtieth (60th) day prior to the expiration of this Lease, have the option to renew this <br /> Lease for one (1) year under the same terms and conditions and at a rental rate to be <br /> agreed upon by the parties. <br /> 4. HOLDING OVER: If the Lessee remains in possession of the Leased <br /> Premises after the expiration of this Lease, and without the execution of a new Lease, it <br /> shall be deemed to be occupying the Leased Premises as a tenant from month-to-month, <br /> subject to all conditions, provisions, and obligations of this Lease. <br /> 5. RENTAL: Lessee shall pay to Lessor rent at the rate of SEVEN HUNDRED <br /> and 00/100 Dollars ($700.00) per month for each month during the term of this Lease. <br /> 6. USE OF THE PREMISES: The Leased Premises shall be used to operate <br /> the WIC Program. The Leased Premises shall not be used for any other type of activity <br /> without the express written consent of the Lessor. <br /> 7. QUIET POSSESSION: The Lessor covenants and warrants that the Lessee <br /> has full right and lawful authority to enter into the Leased Premises for the full term as <br /> provided in this Lease. Lessor further covenants and warrants that the Lessee, upon <br /> payment of the rent and perfonnance of all covenants as herein provided, shall peacefully <br /> and quietly have, hold and enjoy the Leased Premises. <br /> . <br />
