<br />~ ~ ;;.-:g 11 <br />""'}~ t ="-' <br />~~ .~~ <br />~ .~ ~- t.~ ~ <br />=-õ ' ........ ...;J ~j <br />;-GJ:J) ~ ORDINANCE 1996 - 54 <br />?~- ~ =., ;::. ~"" <br />~ ;:; ,\; <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING CHAPTER 58, ARTICLE 2 OF THE CITY <br />CODE BY ADDING A PROVISION PROVIDING AUTHORITY TO PARK <br />RANGERS TO ISSUE MUNICIPAL COURT CITATIONS IN PUBLIC PARKS; <br />INCLUDING PROCEDURAL PROVISIONS AND DECLARING AN <br />EMERGENCY. <br />î <br />RECITALS: <br /> <br />1. The City Council declares that a public necessity exists requiring better <br />police coverage in the city's parks and as a response to this public necessity directs the <br />city Parks and Recreation Department to create a Park Ranger program utilizing <br />unarmed uniformed civilians to patrol city parks. <br /> <br />2. A Park Ranger's duties are limited to the enforcement of city ordinances, <br />particularly those relating to parks, education, crime prevention, and public service. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />SECTION 1. That Section 58.036 is added to the San Marcos City Code to <br />read as follows: <br /> <br />Sec. 58.036. Authority of Park Rangers. <br /> <br />Park rangers designated by the director of the city parks and recreation department <br />are authorized to issue Municipal Court citations to enforce this chapter and all city code <br />provisions within city parks. <br /> <br />. <br />SECTION 2. If any word, phrase, clause, sentence, or paragraph of this <br />ordinance is held to be unconstitutional or invalid by a court of competent jurisdiction, the <br />other provisions of this ordinance will continue in force if they can be given;effect without <br />the invalid portion. <br /> <br />SECTION 3. All ordinances and resolutions or parts of ordinances or <br />resolutions in conflict with this ordinance are repealed. <br /> <br />SECTION 4. The importance of this Ordinance creates an emergency and <br />imperative public necessity, and the provisions of the Charter requiring that ordinances <br />be presented at three separate meetings, and that ordinances do not take effect until 10 <br />days after the date of final passage are suspended, and this ordinance will take effect <br />upon publication of notice of its adoption in a newspaper of general circulation in the City. <br /> <br />PASSED, APPROVED AND ADOPTED this 22.llii day of ,Tu1y ,1996. <br /> <br /> <br />t)~ ~. ~ <br /> <br />Billy G.
