<br /> 24 <br /> RESOLUTION 1996- l23 R <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS, AUTHORIZING THE PARTICIPATION OF THE <br /> CITY OF SAN MARCOS WITH OTHER TEXAS CITIES IN THE <br /> TEXAS COALITION OF CITIES FOR FRANCHISED UTILITY <br /> ISSUES; NAMING A REPRESENTATIVE TO THE STEERING <br /> - COMMITTEE; AUTHORIZING PAYMENT OF A PARTICIPATION <br /> f FEE AND PROVIDING AN EFFECTIVE DATE. <br /> RECITALS: <br /> 1. Market forces, technological changes, utility industry practices, and federal <br /> and state legislative and administrative body rulemaking have greatly impacted the ability <br /> of cities to main,tain local control of land use decisions, city property and utility rate <br /> regulatory authority, and to preserve city revenue streams and a meaningful role for cities <br /> as a process participant. <br /> 2. It is imperative that the City stay informed in these matters, and participate <br /> and work cooperatively to protect the interests of the City and the public. <br /> 3. There exists among Texas cities a strong interest in participating in a <br /> common effort to protect these interests. <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> PART 1. The City of San Marcos agrees to participate with such other Texas cities <br /> in the Texas Coalition of Cities for Franchised Utility Issues ("Coalition"). The coalition will <br /> (a) collect, analyze, discuss and distribute information on utility related matters; (b) <br /> participate and develop positions in utility regulatory body rulemaking dockets and on bills <br /> proposed in the legislature relating to utility matters; and (c) work cooperatively on matters <br /> relating to utility matters; and (c) work cooperatively on matters relating to utility franchises <br /> and fee issues. <br /> PART 2. The City Manager, Larry D. Gilley, or his designee may participate on the <br /> Coalition Committee and is authorized to receive notices concerning Coalition Committee <br /> activities at the following address: <br /> Larry D. Gilley, City Manager <br /> City of San Marcos <br /> 630 East Hopkins <br /> San Marcos, Texas 78666 <br /> 512/393-8100 <br /> 512/396-4656 Fax <br /> PART 3. The City authorizes payment to the Coalition of the participation fee <br /> in the amount of $1 ,437.15. <br /> PART 4. The City Manager, Larry D. Gilley, is authorized to take those steps <br /> ! reasonable and necessary to comply with the intent of this resolution. <br /> PART 5.
