That Section 2.069 of the San Marcos City Code is amended to read <br />as follows: <br /> <br />Sec.. 2.069. Absence from meetings. <br /> <br />(a) The voluntary absence of a board or commission member from three <br />consecutive meetings of the board or commission will result in automatic <br />resignation of the member from the board or commission. <br /> <br />(b) An absence of a member from a board or commission meeting may be <br />regarded as excused, rather than voluntary, at the discretion of the board or <br />commission or its chair, if it results from illness or from a factor beyond the <br />control of the board or commission member. <br /> <br />(c) The absence of a board or commission member, whether voluntary or <br />excused, from 20% or more of the board or commission's meetings during the <br />preceding 12 months will result in automatic resignation of the member from <br />the board or commission. Within this subsection, "meeting" includes <br />workshops and any other posted meetings of the board or commission. <br /> <br />(d) The chair of a board or commission will inform the city secretary of the <br />automatic resignation of a member of the board or commission under <br />subsection (a) or (c). The city secretary shall submit the member's position to <br />the city council for appointment of a replacement. <br /> <br />SECTION 2. If any word, phrase, clause, sentence, or paragraph of this ordinance <br />is held to be unconstitutional or invalid by a court of competent jurisdiction, the other <br />provisions of this ordinance will continue in force if they can be given effect without the <br />invalid portion. <br /> <br />SECTION 3. All ordinances and resolution or parts of ordinances or resolutions in <br />conflict with this ordinance are repealed. <br /> <br />SECTION 4. This Ordinance will take effect 10 days after the date of its final <br />passage, and the City Secretary will publish notice of its adoption in a newspaper of <br />general circulation in the City. <br /> <br />PASSED AND APPROVED on first reading July 8, 1996" <br /> <br />PASSED AND APPROVED on second reading July 22, 1996. <br /> <br />PASSED, APPROVED AND ADOPTED August 12, 1996. <br /> <br />~~.~ <br /> <br />Billy G.
