<br /> ... 71 <br /> r <br /> - CSJ 0366-01-051 <br /> Travis County <br /> STATE OF TEXAS § <br /> § <br /> COUNTY OF TRAVIS § <br /> I <br /> \ THIS AGREEMENT is made between the City of San Marcos <br /> hereinafter called the "city", acting by and through its duly <br /> authorized Officers and the State of Texas, hereinafter called <br /> the" State", acting by and through its Texas Transportation <br /> Commission. <br /> WHEREAS~' in consideration of mutual covenants and agreements <br /> herein contained, the City desires improvemen t s to the <br /> intersection of SH 123 at FM 621. The City has requested the <br /> State to construct or have constructed this work on behalf of the -- <br /> city. The estimated cost of City's work is Twenty One Thousand <br /> Four Hundred Twenty Three and 55/100 dollars, ($21,423.55) which <br /> includes the estimated construction cost, preliminary engineering <br /> costs, construction engineering costs and indirect.costs as <br /> detailed in Exhibit A. <br /> NOW THEREFORE, it is understood that this proposed work, <br /> approved for inclusion into a construction contract by the State, <br /> will be constructed by the State and the City will transmit to <br /> the State with the return of thi s agreemen t, executed by the <br /> City, a check made payable to the Texas Department of <br /> Transportation in the amount of Twenty One Thousand Four Hundred <br /> ! -- Twenty Three and 55/100 dollars, ($21,423.55) In the event it is <br /> determined the funding provided by the City will be insufficient <br /> \ to cover the State's costs under this agreement, the City will <br /> -- within 30 days from receipt of the State's written notification <br /> provide the additional funding to cover the State's anticipated <br /> additional costs. In the event the amount as paid is more than <br /> the actual cost of the City's share, as herein established, then <br /> the excess amount will be returned to the City. In the even t . tha t <br /> the project is not constructed, the amount paid in excess of the <br /> actual costs incurred by the State will be returned to the City. <br /> Page 1 of 2 <br />
