... 71 r - CSJ 0366-01-051 Travis County STATE OF TEXAS § § COUNTY OF TRAVIS § I \ THIS AGREEMENT is made between the City of San Marcos hereinafter called the "city", acting by and through its duly authorized Officers and the State of Texas, hereinafter called the" State", acting by and through its Texas Transportation Commission. WHEREAS~' in consideration of mutual covenants and agreements herein contained, the City desires improvemen t s to the intersection of SH 123 at FM 621. The City has requested the State to construct or have constructed this work on behalf of the -- city. The estimated cost of City's work is Twenty One Thousand Four Hundred Twenty Three and 55/100 dollars, ($21,423.55) which includes the estimated construction cost, preliminary engineering costs, construction engineering costs and indirect.costs as detailed in Exhibit A. NOW THEREFORE, it is understood that this proposed work, approved for inclusion into a construction contract by the State, will be constructed by the State and the City will transmit to the State with the return of thi s agreemen t, executed by the City, a check made payable to the Texas Department of Transportation in the amount of Twenty One Thousand Four Hundred ! -- Twenty Three and 55/100 dollars, ($21,423.55) In the event it is determined the funding provided by the City will be insufficient \ to cover the State's costs under this agreement, the City will -- within 30 days from receipt of the State's written notification provide the additional funding to cover the State's anticipated additional costs. In the event the amount as paid is more than the actual cost of the City's share, as herein established, then the excess amount will be returned to the City. In the even t . tha t the project is not constructed, the amount paid in excess of the actual costs incurred by the State will be returned to the City. Page 1 of 2
