RECITALS: 1. On June 25, 1996, the Planning and Zoning Commission of the City of San Marcos held a public hearing regarding a request to change the zoning from "POD" Planned Development District to "P" Public and Institutional District for a 28.37 acre tract of property located at 301 Foxtail Run. 2. Subsequent to the public hearing on that date, the Planning and Zoning Commission did, on June 25, 1996 consider and vote to approve the request, and has recommended that the request be approved by the City Council of the City. , 3. The City Council held a public hearing on the 26th day of Auqust , 1996, regarding the request. 4. All requirements of Chapter 114, Zoning, of the San Marcos City Code pertaining to zoning map amendments have been met. 5. The City Council hereby finds and determines that the adoption of the following ordinance is in the interest of the public health, morals, welfare and safety. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. The Official Zoning Map of the City, as described in Section 114.029 of the San Marcos City Code, is amended to rezone the following real property which is presently zoned "POD" Planned Development District to "P" Public and Institutional District: Street address: 301 Foxtail Run Size: 28.37 acres. Legal description: Lot 1, Block 1, Hunter's Hill Subdivision, Section 1. Deed or plat reference: Volume 6, pages 177-178, Hays County Plat Records. SECTION 2. Any person violating any provision of this ordinance shall be deemed guilty of a misdemeanor and upon conviction shall be subject to the penalty provided in Section 1.015 of the San Marcos City Code. I SECTION 3. After its original passage, this ordinance will be subject to reconsideration at the next regular City Council meeting. If this ordinance is not reconsidered, or if it is reconsidered and approved, notice of its adoption will be published in a newspaper of general circulation in the City. This ordinance wiil take effect upon publication of this notice. PASSED, APPROVED AND ADOPTED this 26 day of August, 1996, subject to reconsideration at the next regular City Council meeting scheduled for september 9., 1996.
