<br />D~ ~ ~ 8 85 <br />-'!=" ~ ;:5 ~ <br />hi g :......;'-'::: <br />~~ .- =$ <br />-1 =-, ~ f:d as <br />U::3 ê ~; ORDINANCE 1~6-~ <br />~ ~a <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING <br />MAP OF THE CITY BY REZONING A 1.34 ACRE TRACT OF <br />PROPERTY LOCATED AT 1522 RANCH ROAD 12 FROM <br />"C" COMMERCIAL DISTRICT TO "MF-4" MULTI-FAMILY, <br />DISTRICT (HIGH DENSITY); INCLUDING PROCEDURAL <br />, PROVISIONS; AND PROVIDING FOR PENALTIES. <br /> <br />RECITALS: <br /> <br />1. On July 23, 1996, the Planning and Zoning Commission of the City of San <br />Marcos held a public hearing regarding a request to change the zoning from "C" <br />Commercial District to "MF-4" Multi-Family District (High Density) for a 1.34 acre tract of <br />property located at 1522 Ranch Road 12. <br /> <br />Subsequent to the public hearing on that date, the Planning and Zoning <br />Commission did, on July 23, 1996 consider and vote to approve the request, and has <br />recommended that the request be approved by the City Council of the City. <br /> <br />3. The City Council held a public hearing on the 26th day of <br />Auqust , 1996, regarding the request. <br /> <br />4. All requirements of Chapter 114, Zoning, of the San Marcos City Code pertaining <br />to zoning map amendments have been met. <br /> <br />5. The City Council hereby finds and determines that the adoption of the following <br />ordinance is in the interest of the public health, morals, welfare and safety. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. The Official Zoning Map of the City, as described in Section 114.029 <br />of the San Marcos City Code, is amended to rezone the following real property which is <br />presently zoned "C" Commercial District to "MF-4" Multi-Family District (High Density): <br /> <br />Street address: 1522 Ranch Road 12 <br /> <br />Size: 1.34 acres. <br /> <br />Legal description: Lot 1-C, Highcrest Addition. <br /> <br />Deed or plat reference: Volume 4, Page 47, Hays County Plat Records. <br /> <br />SECTION 2. Any person violating any provision of this ordinance shall be deemed <br />guilty of a misdemeanor and upon conviction shall be subject to the penalty provided in <br />Section 1.015 of the San Marcos City Code. <br /> <br />¡ SECTION 3. After its original passage, this ordinance will be subject to <br />reconsideration at the next regular City Council meeting. If this ordinance is not <br />reconsidered, or if it is reconsidered and approved, notice of its adoption will be published <br />in a newspaper of general circulation in the City. This ordinance will take effect upon <br />publication of this notice. <br /> <br />PASSED, APPROVED AND ADOPTED this 26 day of August, 1996, <br />subject to reconsideration at the next regular City Council meeting scheduled for <br />september 9., 1996. <br /> <br />Reconsidered yes no X <br />
