Hopkins <br /> San Marcos, Texas 78666 <br /> Re: Wastewater Treatment Plant Expansion <br /> Equipment Procurement <br /> Grit Concentration and Washing Equipment <br /> Bid Item 5 ' <br /> Recommendation of Award <br /> Dear Mr. Jenkins: <br /> On August 8, 1996 bids were received for selected items of equipment for the Wastewater Treatment <br /> Plant Project. One of the items included in the bid was the grit concpntration and washing <br /> equipment for the new headworks facility for the wastewater treatment plant. Two bids were <br /> received for this equipment: <br /> FMC Corporation $53~ 104.00 <br /> EnviroTech Pump Systems $58,424.00 <br /> The FMC Corporation included their standard terms and conditions as part of their proposal. They <br /> also specifically excluded freight charges to the project. Finally, their proposed delivery time was <br /> unacceptable in consideration of the schedule for construction of this part of the plant. The FMC <br /> Corporation bid should be considered as non-respons'ive. <br /> The EnviroTech Pump Systems proposal referenced its standard terms and conditions, but these were <br /> not included in the bid package. They also requested a limit on liquidated damages exposure of the <br /> full contract amount and to not be held liable for consequential or incidental damages. This amount <br /> is higher than the usual limit of 5 % of the bid amount accepted by most equipment manufacturers. <br /> This equipment can be fabricated and delivered before it needs to be installed. The amount offered <br /> as the cap on damages provides over fifty eight days of damages that could be collected 'if necessary. <br /> We have contacted EnviroTech Pump Systems through their authorized representaTive, W.D. Graue, <br /> Inc., about the referenced terms and conditions and have received the attached letter confirming that <br /> they will aécept the terms and conditions of the Procurement Documents. The proposal is for <br /> WEMCO equipment which is one of the specified manufacturers. The prices bid are competitive <br /> and less than the amount estimated for this equipment. <br /> Freese and Nichols, Inc.
