Hopkins <br /> San Marcos, Texas 78666 <br /> Re: Wastewater Treatment Plant Expansion <br /> Equipment Procurement <br /> Recommendation of A ward <br /> Dear Mr. Jenkins: <br /> On August 8, 1996 bids were received for selected items of equipment for the Wastewater Treatment Plant <br /> Project. Equipment requiring a long time for fabrication and delivery were selected for this bid package <br /> . <br /> to help expedite the construction of the treatment plant. The general construction contract for the plant will <br /> be advertised on August 22, 1996. The project will be in operation by December 31, 1997, Bids were <br /> received from 15 vendors for 9 different pieces of equipment. The attached tabulation will provide a <br /> summary of the bids received. Two bids were submitted without a cashiers check or bid bond, We <br /> recommend that these bids be considered as non-responsive. <br /> The last column in the tabulation will indicate our recommendation for award of contracts for the bids <br /> received. This recommendation is based on our review of the bid documents and the terms and conditions <br /> proposed as well as comments from Black & Veatch regarding technical provisions or clarifications <br /> included in the bid documents, Please note that several of the items recommend award of a contract <br /> pending receipt of written confinnation that the bidder will accept the terms and conditions of the contract <br /> documents. Bids submitted by equipment manufacturers commonly have attached the manufacturer's <br /> standard terms and conditions. We have contacted each bidder that listed such an exception and they have <br /> agreed to write a letter accepting the terms of the contract offered by the City, Several have asked for <br /> limits on the maximum amount ofliquidated damages they will be subjected to.
