<br /> Premises, (2) that in the construction of any improvements on, over, or under the
<br /> Leased Premises and the furnishing of services, no person on the grounds of sex,
<br /> race, creed, color, disability or national origin shall be excluded from participation
<br /> in, denied the benefits of, or otherwise be subjected to discrimination, and (3) that
<br /> the Lessees shall use the premises in compliance with all other requirements
<br /> imposed by or pursuant to 49 CFR Part 21, Nondiscrimination in Federally Assisted
<br />- Programs of the Department of Transportation, as amended.
<br /> 15.7 The Lessees assure that it will undertake an affirmative action program as required
<br /> by 14 CFR Part 152, Subpart E, to ensure that no person shall on the grounds of
<br /> sex, race, creed, color, disability or national origin be excluded from participating
<br /> in any employment activities covered in 14 CFR Part 152, Subpart E. The Lessees
<br /> assure that no person shall be excluded on these grounds from participating in or
<br /> receiving the services or benefits of any program or activity covered by this subpart.
<br /> The Lessees assure that they will require that their covered suborganizations
<br /> provide assurances to the Lessees that they similarly will undertake affirmative
<br /> action programs and that they will require assurances from their suborganizations,
<br /> as required by 14 CFR Part 152, Subpart E, to the same effect.
<br /> 15.8 That in the event of breach of any of the preceding nondiscriJ11ination covenants,
<br /> Lessor shall have the right to terminate the Lease and to reenter and repossess the
<br /> Leased Premises in accordance with Article 13.
<br /> 15.9 During the time of war or national emergency, Lessor shall have the right to lease
<br /> the landing area or any part of the area to the United States Government for military
<br /> use, and, if a lease is executed, the provisions of this instrument insofar as they are
<br /> inconsistent with the provisions of the lease to the United States Government, shall
<br /> be suspended.
<br /> ARTICLE 16.
<br /> Miscellaneous
<br /> 16.1 Whenever the singular number is used, the same shall include the plural, and the
<br /> neuter gender shall include the feminine and masculine genders.
<br /> 16.2 If any clause or provision of this Lease is illegal, invalid or unenforce~ble under
<br /> present or future laws, the remainder of this Lease shall not be affected, and the
<br /> parties declare that this Lease would have been entered into without such
<br /> unenforceable portion.
<br /> 16.3 This Lease may not be altered or amended, except by instrument in writing signed
<br /> by both parties. The terms, provisions, covenants and conditions contained in
<br /> this Lease shall apply to, inure to the benefit of, and be binding upon the parties,
<br /> and upon their respective successors in interest and legal representatives, except
<br /> as otherwise expressly provided.
<br /> 16.4 The captions used in this Lease are for convenience only and do not in any way
<br /> limit or amplify the terms and provisions.

<br />I 16.5 One or more waivers of any covenant, term or condition of this Lease by either
<br />L- party shall not be deemed as a waiver by that party as to any subsequent similar
<br /> act or omission.
<br /> 16.6 Whenever a period of time is prescribed for action to be taken by Lessor, Lessor
<br /> shall not be liable or responsible for, and there shall be excluded from the
<br /> computation of any such period of time, any delays due to strikes, riots, acts of
<br /> God, shortages of labor or materials, war, governmental laws, regulations or
<br /> restrictions or any other causes of any kind whatsoever which are beyond the
