for (.J -8- - the Construction Contract, and any and all change orders pertaining to the construction of a Gravity flow wastewater line from the Gary Job Corps Center's existing wastewater treatment plant to the City's preferred Lift Station site as illustrated on Exhibit "A", less the estimated cost of the Proposed Force Main illustrated in Exhibit "8," as determined by the successful bidder's final bid. 0 OH 5.04 Once bids for the Project have been accepted and the Construction Contract has been executed, the Project Manager, on a monthly basis, shall prepare and deliver an invoice, based upon recommendations from the Engineer and in accordance with the percentage of completion of construction, including expenses incurred, to the City and the DOL for their prorata share of such costs as outlined in this Article 5. It is the understanding of the parties that each shall be entitled to have their own inspector/quality control person visit the worksite in advance and review the recommendations of the Engineer, provided, however, if any of the inspectors/quality control persons disagree with the recommendations of the Engineer and the Engineer elects not to change its recommendations, the recommendations of the Engineer shall control and the parties shall have the obligation to pay their prorata share of all costs and expenses based upon the recommendation of the Engineer. 5.05 The DOL shall be responsible for approving the Project Manager's deduction from the escrow account established in Paragraph 4.06, of the DOL's share of the monthly costs and expenses as set forth in the invoices, no later than fifteen (15) days following receipt of each invoice.
