273. <br /> <br />RESOLUTION NO. 2003-- J. 24 m <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, APPROVING THE TERMS AND <br />CONDITIONS OF AN INTERLOCAL AGREEMENT FOR PARK <br />CONSTRUCTION AND MAINTENANCE BETWEEN THE CITY <br />AND HAYS COUNTY FOR A PARK AT THE INTERSECTION <br />OF BROADWAY STREET AND LOCKWOOD STREET; <br />AUTHORIZING THE CITY MANAGER TO EXECUTE THE <br />AGREEMENT; AND DECLARING AN EFFECTIVE DATE. <br /> <br />RECITALS: <br /> <br /> 1. The Inteflocal Cooperation Act (Chapter 79l, Texas Government Code) empowers the City <br />to contract with other governmental entities in the performance of govemunental ftmctions, including <br />fm~ctions and services in the area of parks construction and maintenance. <br /> <br /> 2. The City has proposed to construct and maintain a park within an area of property ovmed <br />by Hays County at the intersection of Broadway Street and Lockwood Street as depicted on the attached <br />Exhibit A (the "Property"). <br /> <br /> 3. The City and Hays County have negotiated the attached agreement for the County to grant <br />permission to the City for the construction and maintenance of a City park on the Property. <br /> <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br /> PART 1. The attached Interlocal Agreement for Park Construction and Maintenance <br />between the City and Hays County pertaining to a park on the Property is approved. <br /> <br /> PART 2. The City Manager, Dan O'Leary, is authorized to execute the agreement on behalf <br />of the City. <br /> <br />PART 3.
