<br />163 <br /> <br /> <br /> <br /> <br />RESOLUTION 1996 - ] fi fiR <br /> <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF <br />THE CITY OF SAN MARCOS, TEXAS <br />i RESCINDING THE SALE OF A PORTION OF <br />! LOT 24, WEATHERFORD SUBDIVISION TO <br />RUSSELL SMITH; AND DECLARING AN <br />EFFECTIVE DATE. <br /> <br />RECITALS: <br /> <br />1. On June 24, 1996, the City Council approved the sale of a parcel of real property <br />identified as a portion of Lot 24, Weatherford Subdivision of San Marcos, located in the <br />600 block of Knox Street in San Marcos, Texas. <br /> <br />2. The City staff has learned that there is a drainage ditch located on the property <br />which makes the property unsuitable for building any type of structure. <br />~ <br />3. The City received $2,000.00 from Russell Smith for the property, and the parties <br />have agreed to rescind the sale so the City can refund the $2,000 purchase price to Mr. <br />Smith. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />PART 1. The rescission of the sale of the parcel of real property described <br />above and the refund of $ 2,000.00 purchase price to Russell Smith is approved. <br /> <br />PART 2.
