"-.) ~ <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING <br />MAP OF THE CITY BY REZONING A 5.28 ACRE TRACT OF <br />PROPERTY LOCATED IN THE 1700 BLOCK OF RANCH <br />ROAD 12 FROM "C" COMMERCIAL DISTRICT TO "MF-2" , <br />MULTI-FAMILY DISTRICT (MEDIUM DENSITY); INCLUDING <br />~.~ PROCEDURAL PROVISIONS; AND PROVIDING FOR <br />I PENALTIES. <br />I <br />I <br />RECITALS: <br /> <br />1. On August 27,1996, the Planning and Zoning Commission of the City of San <br />Marcos held a. public hearing regarding a request to change the zoning from "C" <br />Commercial District to "MF-2" Multi-Family District (Medium Density) for a 5.28 acre tract <br />of property located on the North Side of Ranch Road 12, West of Bishop Street (1700 <br />Block of Ranch Road 12). <br /> <br />2. Subsequent to the public hearing on that date, the Planning and Zoning <br />Commission did, on August 27, 1996 consider and vote to approve the request, and has <br />. <br />recommended that the request be approved by the City Council of the City. <br /> <br />3. The City Council held a public hearing on the 14th day of <br />October , 1996, regarding the request. <br /> <br />4. All requirements of Chapter 114, Zoning, of the San Marcos City Code pertaining <br />to zoning map amendments have been met. <br /> <br />5. The City Council hereby finds and determines that the adoption of the following <br />ordinance is in the interest of the public health, morals, welfare and safety. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. The Official Zoning Map of the City, as described in Section 114.029 <br />of the San Marcos City Code, is amended to rezone the following real property which is <br />presently zoned "C" Commercial District to "MF-2" Multi-Family District (Medium Density): <br /> <br />Street address: 1700 Block of Ranch Road 12 <br /> <br />Size: 5.28 acres. <br /> <br />Legal description: See attached Exhibit A. <br /> <br />Deed or plat reference: Volume 83, page 309, Hays County Deed Records. <br /> <br />SECTION 2. The Future Land Use Plan of the San Marcos Horizons City Master <br />Plan is revised to conform to this zoning map amendment. <br />i <br />I <br />¡ SECTION 3. /',ny person violating any provision of this ordinance shall be deemed <br />I guilty of a misdemeanor and upon conviction shall be subject to the penalty provided in <br />Section 1.015 of the San Marcos City Code. <br /> <br />SECTION 4. After its original passage, this ordinance will be subject to <br />reconsideration at the next regular City Council meeting. If this ordinance is not <br />reconsidered, or if it is reconsidered and approved, notice of its adoption will be published <br />in a newspaper of general circulation in the City. This ordinance will take effect upon <br />publication of this notice. <br />
