The Texas Human Resources Code §80.001, provides for a law enforcement agency of any political subdivision of the state to charge a fee, not to exceed $10.00, for fingerprinting services. . . 2. The San Marcos Police Department routinely receives requests from citizens to be fingerprinted. The City determines that it is necessary to recoup a portion of the cost of providing these services. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: < SECTION 1. The San Marcos City Code Chapter 62, Article 2, Division 1 is amended by adding Section 62.027 to read as follows: Sec. 62.027 Fingerprinting for identification. (a) The police department shall charge a fee for fingerprinting services described in this division in an amount established by the city council. Fingerprinting of i children under the age of 17 at the request of their parent or legal guardian is exempt from this fee. \ (b) Public fingerprinting services shall be available at the San Marcos Police Department only between the hours of 8:00 a.m. and 5:00 p.m., Monday through Friday. SECTION 2. The fee amount of $5.00 per person is established for fingerprinting services provided by the police department under City Code § 62.027. , SECTION 3. If any word, phrase, clause, sentence, or paragraph of this ordinance is held to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this ordinance will continue in force if they can be given effect without the invalid portion. SECTION 4. All ordinances and resolutions or parts of ordinances or resolutions in conflict with this ordinance are repealed. SECTION 5. Any person violating any provision of this ordinance commits a misdemeanor and is subject to the penalty provided in Section 1.015 of the San Marcos City Code upon conviction. , SECTION 6. This Ordinance will take effect 10 days after the date of its final passage, and the City Secretary will publish notice of its adoption in a newspaper of i general circulation in the City.
