The Texas Human Resources Code §80.001, provides for a law enforcement <br /> agency of any political subdivision of the state to charge a fee, not to exceed <br /> $10.00, for fingerprinting services. <br /> . . <br /> 2. The San Marcos Police Department routinely receives requests from citizens to be <br /> fingerprinted. The City determines that it is necessary to recoup a portion of the <br /> cost of providing these services. <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> < <br /> SECTION 1. The San Marcos City Code Chapter 62, Article 2, Division 1 is <br /> amended by adding Section 62.027 to read as follows: <br /> Sec. 62.027 Fingerprinting for identification. <br /> (a) The police department shall charge a fee for fingerprinting services <br /> described in this division in an amount established by the city council. Fingerprinting of <br /> i children under the age of 17 at the request of their parent or legal guardian is exempt <br /> from this fee. <br /> \ <br /> (b) Public fingerprinting services shall be available at the San Marcos Police <br /> Department only between the hours of 8:00 a.m. and 5:00 p.m., Monday through Friday. <br /> SECTION 2. The fee amount of $5.00 per person is established for <br /> fingerprinting services provided by the police department under City Code § 62.027. <br /> , <br /> SECTION 3. If any word, phrase, clause, sentence, or paragraph of this <br /> ordinance is held to be unconstitutional or invalid by a court of competent jurisdiction, the <br /> other provisions of this ordinance will continue in force if they can be given effect without <br /> the invalid portion. <br /> SECTION 4. All ordinances and resolutions or parts of ordinances or <br /> resolutions in conflict with this ordinance are repealed. <br /> SECTION 5. Any person violating any provision of this ordinance commits <br /> a misdemeanor and is subject to the penalty provided in Section 1.015 of the San Marcos <br /> City Code upon conviction. <br /> , SECTION 6. This Ordinance will take effect 10 days after the date of its final <br /> passage, and the City Secretary will publish notice of its adoption in a newspaper of <br /> i general circulation in the City. <br /> PASSED AND APPROVED on first reading September 9, 1996. <br /> PASSED AND APPROVED on second reading September 23, 1996. <br />
