<br /> 29 <br /> - <br /> RESOLUTION 1996 - 173R <br /> A RESOLUTION OF THE CITY COUNCIL OF <br /> THE CITY OF SAN MARCOS, TEXAS <br /> APPROVING THE SALE OF A TRACT OF <br /> . <br /> ; LAND AT THE SOUTHWEST END OF <br /> RUNWAY NO.1 OF THE MUNICIPAL AIRPORT <br /> SUBDIVISION TO RALPH GIESECKE; <br /> AUTHORIZING THE CITY MANAGER TO <br /> EXECUTE A DEED; AND DECLARING AN <br /> EFFECTIVE DATE. <br /> . . <br /> RECITALS: <br /> 1. Ralph Giesecke owns Lot 27 and 16.5 acres, more or less, of the Municipal Airport <br /> Subdivision, and he has proposed to purchase a 10,610 square foot area at the southwest <br /> end of Runway No.1, which is located between his two pieces of property. <br /> . <br /> 2. Section 272.001 (b)(1) of the Texas Local Government Code provides an exception <br /> to the bidding process regarding the sale of this type of property by a municipality. <br /> 3. The property has been appraised at $1,700. <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> PART 1. The sale of the portion of Runway No.1 described above for <br /> $ 1,700.00 to Ralph Giesecke is approved contingent on approval by the Planning and <br /> Zoning Commission of the plat of the property and the property currently owned by Mr. <br /> Giesecke. <br /> PART 2. The City Manager, Larry D. Gilley, is authorized to execute the <br /> attached Special Warranty Deed conveying to Ralph Giesecke the property described <br /> above if the contingency in Part 1 is satisfied. <br /> PART 3.
