4/£ - Page 6 of 8. replacement value of such equipment, and Debtor shall provide the City with a certificate of insurance verifying this coverage within 10 days of execution of this Agreement and annually thereafter. All certificates shall contain a provision that the coverage will not be canceled or materially changed until at least thirty (30) days written notice has been given to the City. 4.6 In performance of this Agreement, the Debtor agrees that it will not discriminate against any customer or employee because of race, color, religion, sex, national origin, age or disability. Debtor will take affirmative action to ensure that applicants are employed, and that employees are treated during employment, without regard to race, color, religion, sex, national origin, age or disability. Such action shall include, but not be limited to, the following: employment, upgrading, demotion, or transfer; recruitment or recruitment advertising; and, selection for training, including apprenticeship. Debtor agrees to post in conspicuous places available to employees and applicants for employment, notices setting forth the provision of this non-discrimination clause. Debtor further agrees that all advertisements or solicitations for employees placed by or on behalf of Debtor will include the statement that all qualified applicants will receive consideration for employment without regard to race, color, religion, sex, national origin, age or disability. Debtor must submit copies of all advertisements or solicitations for employees to the City or the City's designated representative. . 4.7 Debtor shall comply with the provisions of the Civil Rights Act of 1964, as amended, which states that no person shall, on the grounds of race, color, or national origin, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any program or activity receiving federal financial assistance. 4.8 The Housing and Community Development Act of 1974 provides that: "No person in the United States shall, on the ground of race, color, national origin or sex be excluded from participation in, be denied the benefits of or be subjected to discrimination under any program or activity funded in whole or in part with funds made available under this title. Any prohibition against discrimination on the basis of age under the Age Discrimination Act of 1975 [42 USCS 1601 et seq.] or with respect to an othelWise qualified handicapped individual as provided in Section 504 of the Rehabilitation Act of 1973 [29 USCS 794] shall also apply to such program or activity." Debtor agrees to comply with the foregoing conditions and requirements. 4.9 Debtor guarantees that any building which is constructed or renovated for its use during the term of this Agreement and the repayment of the HUD-EDP loan, shall be constructed or renovated, whether with HUD-EDP funds or with private funds, in compliance with the Americans with Disabilities Act of 1990, which includes but is not limited to a specific requirement for handicap access and the Texas Accessibility Standards (Article 9102, Texas Civil Statutes).
