<br /> 4/£ <br /> - Page 6 of 8. <br /> replacement value of such equipment, and Debtor shall provide the City with a certificate <br /> of insurance verifying this coverage within 10 days of execution of this Agreement and <br /> annually thereafter. All certificates shall contain a provision that the coverage will not be <br /> canceled or materially changed until at least thirty (30) days written notice has been given <br /> to the City. <br /> 4.6 In performance of this Agreement, the Debtor agrees that it will not discriminate <br /> against any customer or employee because of race, color, religion, sex, national origin, <br /> age or disability. Debtor will take affirmative action to ensure that applicants are <br /> employed, and that employees are treated during employment, without regard to race, <br /> color, religion, sex, national origin, age or disability. Such action shall include, but not be <br /> limited to, the following: employment, upgrading, demotion, or transfer; recruitment or <br /> recruitment advertising; and, selection for training, including apprenticeship. Debtor <br /> agrees to post in conspicuous places available to employees and applicants for <br /> employment, notices setting forth the provision of this non-discrimination clause. Debtor <br /> further agrees that all advertisements or solicitations for employees placed by or on behalf <br /> of Debtor will include the statement that all qualified applicants will receive consideration <br /> for employment without regard to race, color, religion, sex, national origin, age or disability. <br /> Debtor must submit copies of all advertisements or solicitations for employees to the City <br /> or the City's designated representative. . <br /> 4.7 Debtor shall comply with the provisions of the Civil Rights Act of 1964, as amended, <br /> which states that no person shall, on the grounds of race, color, or national origin, be <br /> excluded from participation in, be denied the benefits of, or be subjected to discrimination <br /> under any program or activity receiving federal financial assistance. <br /> 4.8 The Housing and Community Development Act of 1974 provides that: "No person <br /> in the United States shall, on the ground of race, color, national origin or sex be excluded <br /> from participation in, be denied the benefits of or be subjected to discrimination under any <br /> program or activity funded in whole or in part with funds made available under this title. <br /> Any prohibition against discrimination on the basis of age under the Age Discrimination Act <br /> of 1975 [42 USCS 1601 et seq.] or with respect to an othelWise qualified handicapped <br /> individual as provided in Section 504 of the Rehabilitation Act of 1973 [29 USCS 794] shall <br /> also apply to such program or activity." Debtor agrees to comply with the foregoing <br /> conditions and requirements. <br /> 4.9 Debtor guarantees that any building which is constructed or renovated for its use <br /> during the term of this Agreement and the repayment of the HUD-EDP loan, shall be <br /> constructed or renovated, whether with HUD-EDP funds or with private funds, in <br /> compliance with the Americans with Disabilities Act of 1990, which includes but is not <br /> limited to a specific requirement for handicap access and the Texas Accessibility <br /> Standards (Article 9102, Texas Civil Statutes). <br />
