On September 10, 1996, the Planning and Zoning Commission of the City of San <br /> 14 Marcos held a public hearing regarding a request to change the zoning from "PO" Pre- <br /> 15 Development District to "MF-2" Multi-Family District (Medium Density) for a 4.0 acre tract <br /> 16 of property located at 1750 River Road. <br /> 17 <br /> 18 2. Subsequent to the public hearing on that date, the Planning and Zoning <br /> 19 Commission did, on September 1 0, 1996 consider and vote to approve the request, and <br /> 20 has recommended that the request be approved by the City Council of the City. <br /> 21 <br /> < <br /> 22 3. The City Council held a public hearing on the 28th day of <br /> 23 October , 1996, regarding the request. <br /> 24 <br /> 25 4. All requirements of Chapter 114, Zoning, of the Sàn Marcos City Code pertaining <br /> 26 to zoning map amendments have been met. <br /> 27 <br /> 28 5. The City Council hereby finds and determines that the adoption of the following <br />! 29 ordinance is in the interest of the public health, morals, welfare and safety. <br /> 30 <br />: <br />! 31 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> 32 TEXAS: <br /> 33 <br /> 34 SECTION 1. The Official Zoning Map of the City, as described in Section 114.029 <br /> 35 of the San Marcos City Code, is amended to rezone the following real property which is <br /> 36 presently zoned "PO" Pre-Development District to "MF-2" Multi-Family District (Medium <br /> 37 Density): <br /> 38 <br /> 39 Street address: 1750 River Road <br /> 40 <br /> 41 Size: 4.0 acres. <br /> 42 <br /> 43 Legal description: Lot 1, J.O. Paine Property Addition. <br /> 44 <br /> 45 Deed or plat reference: Volume 3, page 171, Hays County Plat Records. <br /> 46 <br /> 47 <br /> 48 SECTION 2. Any person violating any provision of this ordinance shall be deemed <br /> 49 guilty of a misdemeanor and upon conviction shall be subject to the penalty provided in <br />¡ <br />I 50 Section 1.015 of the San Marcos City Code. <br />¡ 51 <br />! <br /> 32 SECTION 3. After its original passage, this ordinance will be subject to <br /> 53 reconsideration at the next regular City Council meeting. If this ordinance is not <br /> 54 reconsidered, or if it is reconsidered and approved, notice of its adoption will be published <br /> 55 in a newspaper of general circulation in the City. This ordinance will take effect upon <br /> 56 publication of this notice. <br /> 57 <br /> 58 PASSED, APPROVED AND ADOPTED this28th:lay of October ,1996, <br /> 59 subject to reconsideration at the next regular City Council meeting scheduled for <br /> 60 November 4, 1996. <br />
