<br /> 78 <br /> RESOLUTION 1996- 191 R <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS, URGING THE TEXAS MUNICIPAL LEAGUE TO <br /> CONSIDER AND ADOPT A RESOLUTION RELATING TO THE <br /> CONSOLIDATED FARM AND RURAL DEVELOPMENT ACT (7 <br /> U.S.C. SECTION 1926); AND DECLARING AN EFFECTIVE DATE. <br />RECITALS: <br />1. Local governments have traditionally assumed as their governmental role the tasks <br />of providing water supply, water distribution, wastewater collection and treatment, and <br />drainage services to their local communities. <br />2. In 1961 Congress passed the Consolidated Farm and Rural Development Act (7 <br />U.S.C. §1926) (the "Act") which provided for the Secretary of Agriculture to "make or insure <br />loans to associations ... to provide for the conservation, development, use, or control of <br />water, and the installation or improvements of drainage or waste disposal facilities primarily <br />serving farmers, ranchers, farm tenants, farm laborers, rural businesses, and other rural <br />residents". <br />3. In practice the Act encourages rural water supply associations "and corporations to <br />obtain and exercise control of water supply and water distribution systems, wastewater <br />systems, and drainage systems without notice to local governments that provide such <br />services and without adequate local community planning oversight. <br />4. Some water supply associations and corporations are using the Act to limit the <br />economic development of growing and urban communities, and sometimes, even to extort <br />fees from communities or land owners for provision of basic utility service. <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br />PART 1. The City Council directs the City staff to support the attached resolution for <br />consideration by the Texas Municipal League at its annual convention, and that the <br />members of the League are requested and encouraged to adopt the Resolution, and act <br />accordingly. <br />PART 2.
