f3£ ORDINANCE NO. - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AUTIIORIZING THE ISSUAL'fCE AND SALE OF CITY OF SAN MARCOS, TEXAS, WATERWORKS AND SEWER SYSTEM REVENUE BONDS, SERIES 1996- C, IN THE AGGREGATE PRINCIPAL AL'10UNT OF $2,000,000; PRESCRIBING THE FORM OF SAID BONDS; PROVIDING FOR THE SECURITY FOR AND PAYMENT OF SAID BONDS; AWARDING THE SALE THEREOF; APPROVING THE OFFICIAL STATEMENT; ENACfING OTHER PROVISIONS RELATING TO THE SUBJECf; AND DECLARING AN EMERGENCY - WHEREAS, this City Council (the "City Council"), by resolution adopted on November 25, 1996, directed publication of notice of the intention of the City of San Marcos, Texas (the "City") to issue not to exceed $2,000,000 waterworks and sewer system revenue bonds of the City for the purposes set forth in such notice; WHEREA~, ~uch notice was published in the manner and to the extent required by law; WHEREAS, there has not been filed with the City Secretary or any other office of the City a petition protesting the issuance of such revenue bonds and requesting an election on same; and WHEREAS, it is affmnatively found and determined that the City is authorized to proceed with the issuance and sale of such revenue bonds as authorized by the laws of the State of Texas, including, particularly, Tex. Rev. Civ. Stat. Ann. arts. 2368a and 1111, et seq.; Now, Therefore . BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS: ARTICLE I DEFINITIONS AND OTHER PRELIMlNAR Y MATTERS Section 1.01. Defmitions. Unless otherwise expressly provided or UIÙess the context clearly requires otherwise, in this Ordinance the following terms shall have the meanings specified below: - "Additional Parity Obligations" means those obligations the City reserves the right to issue on a parity \,;1th the Bonds, herein authorized in aœordance with the terms and conditions prescribed in Section 9.01 hereof. "Bond" means any of the Bonds. "Bonds" means the City's bonds entitled "City of San Marcos, Texas, Waterworks and Sewer System Revenue Bonds, Series 1996-C" authorized to be issued by Section 3.01 of this Ordinance. "Closing Date" means the date of the initial delivery of and payment for the Bonds.
