The <br /> value of a street segment app~aised as a unit will be divided pro rata on an area <br /> basis among two or lT1ore ab~tting owne~s.' <br /> (e) If an abandonment involves utility re!9cation or survey costs, the deeds <br /> for the abandoned area will be delivered upon payment by the abutting owners <br /> of those costs. <br /> SECTION 2. That the amount of the administrative fee for street and alley <br /> abandonment applications under Section 25-92(c)(1) of the San Marcos Code of <br /> Ordinances is set at $100.00. <br /> SECTION 3. That if any word, phrase, clause, sentence, or paragraph of this <br /> ordinance is held to be unconstitutional or invalid by a court of competent jurisdiction, the <br /> remaining provisions of this ordinance shall remain in effect as if the unconstitutional or <br /> invalid portion had not been adopted. <br /> SECTION 4. That all ordinances and resolutions or parts of ordinances or <br /> resolutions in conflict herewith, including Resolution 1987-16R, are hereby repealed. <br /> SECTION 5. That any person violating any provision of this ordinance shall be <br /> deemed guilty of a misdemeanor and upon conviction shall be subject to the penalty <br /> provided in Section 1-5 of the San Marcos Code of Ordinances. <br /> SECTION 6. That this Ordinance shall be in effect ten (10) days from and after its <br /> passage, and it shall be published in a newspaper of general circulation in the area as <br /> required by the Charter of the City of San Marcos, Texas. <br /> PASSED AND APPROVED on first reading December 12, 1994. <br /> PASSED AND APPROVED on second reading January 9, 1995., <br /> PASSED, APPROVED AND ADOPTED January 23, 1995. <br /> VìA.~ <br /> s <br /> q~~~ Approved: <br /> ~ô,~ <br /> J is K.
