(d) Deeds for abandoned streets will be delivered upon payment by the abutting owners of the fair market va!ùe of the areas covered by the deeds. The value of a street segment app~aised as a unit will be divided pro rata on an area basis among two or lT1ore ab~tting owne~s.' (e) If an abandonment involves utility re!9cation or survey costs, the deeds for the abandoned area will be delivered upon payment by the abutting owners of those costs. SECTION 2. That the amount of the administrative fee for street and alley abandonment applications under Section 25-92(c)(1) of the San Marcos Code of Ordinances is set at $100.00. SECTION 3. That if any word, phrase, clause, sentence, or paragraph of this ordinance is held to be unconstitutional or invalid by a court of competent jurisdiction, the remaining provisions of this ordinance shall remain in effect as if the unconstitutional or invalid portion had not been adopted. SECTION 4. That all ordinances and resolutions or parts of ordinances or resolutions in conflict herewith, including Resolution 1987-16R, are hereby repealed. SECTION 5. That any person violating any provision of this ordinance shall be deemed guilty of a misdemeanor and upon conviction shall be subject to the penalty provided in Section 1-5 of the San Marcos Code of Ordinances. SECTION 6. That this Ordinance shall be in effect ten (10) days from and after its passage, and it shall be published in a newspaper of general circulation in the area as required by the Charter of the City of San Marcos, Texas.
