1 73D -5- Sec. 12-25. Service charges. (a) The monthly charge and billing procedures for city solid waste service are established by separate ordinance. (b) Each residential unit is assessed a separate charge. A residential unit will be deemed to be occupied and .will be assessed a solid waste charge if electric or water service is provided to the unit. (c) Charges are to be.billed to the person to whom other city utility services for the premises are billed, unless other arrangements are made with the city's approval. Sec. 12-26. Solid waste reserve fund. (a) A solid waste reserve fund is established and will be maintained by the director of finance. A portion of each monthly solid waste service charge as set by separate ordinance will be deposited in the reserve fund. (b) The funds in this account are to be used for pueposes related to the collection or disposal of solid waste. SECTION 2. DEPOSITS. The amount of the deposit for City solid waste services, authorized under City Code Section 12-24, is set as follows: (a) For collection at a single-family residence: Thirty -five dollars ($35.00) or two (2) times the monthly bill, whichever amount is greater. (b) For collection at all other locations: Fifty dollars ($50.00) or two (2) times the monthly bill, whichever amount is greater. SECTION 3. SERVICE CHARGES. (a) The monthly service charge for City solid waste service, authorized under city Code Section 12-25, is set at $8.59 per residential unit. (b) City solid waste service will be billed in a consolidated manner with other City utility services, and is subject to the same due dates, penalty dates, penalty service charges, and service discontinuation as those other utilities. (c) That the amount out of each monthly service charge per residential unit to be deposited to the landfill reserve fund, authorized under City Code Section 12-26, is set at 230. SECTION 4. That if any word, phrase, clause, sentence, or paragraph of this ordinance is held to be unconstitutional or invalid by a court of competent jurisdiction, the remaining provisions of this ordinance shall remain in effect as if the unconstitutional or invalid portion had not been adopted. SECTION 5. That all ordinances and resolutions or parts of ordinances or resolutions in conflict herewith are hereby repealed. SECTION 6. That any person violating any provision of -this ordinance shall be deemed guilty of a misdemeanor and- upon conviction shall be subject to the penalty provided in Section 1-5 of the San Marcos Code of Ordinances.
