<br /> 17711- <br />Sec. 18-4. Care and custody of minor children. <br />(a) It is unlawful for the parent, guardian, or person in custody of any child <br />7 years old or younger to allow the child to enter any city swimming pool unless <br />the child is accompanied by a person at least 14 years of age. <br />(b) This section does not apply to children who are participating in <br />swimming classes conducted by the department. . <br /> -- <br />Sec. 18-5. Restricting motor vehicles in city parks. <br />(a) It is unlawful for any person to drive any motor vehicle on a city park <br />area that is not an improved roadway. <br />(b) It is unlawful for any person to park a motor vehicle in a city park in <br />any area that is not designated by signs or markings as a parking space, <br />(c) This section does not apply to city employees conducting official city <br />business. <br />Sec. 18-6. Prohibiting the possession of alcoholic beverages in ~ertain <br /> parks. , <br />It is unlawful for any person to possess an alcoholic beverage: <br />(1) on or within 500 feet of any softball or baseball field in a city park; <br />(2) within the fenced area surrounding any city swimming pool; or <br />(3) within Children's Park. <br />Sec. 18-7. Fees for park and recreational facilities. <br />Fees and charges for the use of park and recreational facilities are set by <br />separate ordinance, and a schedule of the fees will be kept at the department. <br />Sec. 18-8. Glass beverage containers prohibited. <br />(a) It is unlawful for any person to possess any glass beverage container in <br />any city park, <br />(b) It is unlawful for any person to possess any glass beverage container in <br />or on the waters of the San Marcos River. <br />Sec. 18-9. Smoking and Chewing Tobacco prohibited. <br />It is unlawful for any person to smoke or chew tobacco in the playscape area of <br />Children's Park, <br />SECTION 2. That all fees previously established in Section 18-7 of the San Marcos <br />Code of Ordinances for the use of park and recreational facilities will remain in effect. <br />SECTION 3, That if any word, phrase, clause, sentence, or paragraph of tt-'.J <br />ordinance is held to be unconstitutional or invalid by a court of competent jurisdiction, the <br />remaining provisions of this ordinance shall remain in effect as if the unconstitutional or <br />invalid portion had not been adopted. <br />SECTION 4. That all ordinances and resolutions OJ parts of ordinances or <br />resolutions in conflict herewith are hereby repealed, <br />
