<br /> 17gg <br /> -16- <br /> Sec. 16-63. Posting of signs; means of extinguishment. <br /> (a) Except as provided by the preceding section, the person in control of <br /> a clean air area shall place a sign visible at each entrance to the premises, <br /> notifying persons entering the premises that smoking is prohibited, or that <br /> smoking is prohibited except in designated smoking areas, <br /> (b) The person in control of a facility designated in its entirety as a <br /> smoking area shall place a sign at each entrance to the premises which is clearly <br /> visible and states that smoking is permitted throughout the entire area. <br /> (c) The person in control of a clean air area where signs are required to <br /> be posted under subsection (a) above shall provide ashtrays, containers or other <br /> means of extinguishing smoking materials in proximity to the signs. <br /> (d) Required signs may consists of wording and/or universal symbols. <br /> Sec. 16-64. Places of employment. <br /> Each employer who operates a place of employment in'the city shall adopt, <br /> implement and maintain a written clean air policy which shall contain, at a <br /> minimum, the following provisions and requirements: <br /> (1) Any nonsmoking employee may object to his or her employer about <br /> the designation of a smoking area in any portion of his or her place of <br /> employment normally frequented by the employee. Using already <br /> available means of ventilation, separation or partition, the affected <br /> employees shall attempt to reach a reasonable accommodation, <br /> insofar as possible, betweE?n the preferences of nonsmoking and <br /> smoking employees in designating or redesignating smoking areas, <br /> An employer is not required by this provision to incur any expense, or <br /> make structural or other physical modifications to accommodate the <br /> preferences of non-smoking or smoking employees. <br /> (2) If a prevailing consensus cannot be reached as to any portion of the <br /> , place of employment about which a complaint has been voiced, the <br /> preference of the employer shall prevail. Provided, however, the <br /> requirements of this subsection (2) shall not apply to nonsmoking <br /> employees whose job duties include serving of or routine interaction <br /> with members of the general public within designated sl!1oking areas, <br /> nor to any private enclosed office workspace occupied exclusively by <br /> smokers, even though such office may be visîted by nonsmokers. <br /> (3) The clean air policy shall be posted conspicuously in all workplaces <br /> under the employer's jurisdiction. <br /> Sec. 16-65. Exceptions. <br /> Section 16-61 shall not apply to persons smoking at an event in which an <br /> , entire room or enclosed area is used for a private social function and the event <br /> is under the control of the sponsor of the function and not of the person <br /> otherwis'e in control of the area, This includes, but is not limited to, clean air <br /> areas, such as at hotels, which are normally rented out to private groups, and to <br /> areas of bowling centers used by bowling leagues during league play. <br />
