<br /> ( Î 'i~ <br /> -8- <br />(e) Any order requiring the removal of a nuisance vehicle or vehicle part <br />must include a description of the vehicle and the vehicle identification number <br />and license number, if the information is available at the site. <br />Sec. 16-40. Removal of nuisance vehicle. <br />The city may remove a nuisance vehicle at any time following a public <br />hearing and order of the judge, or fallowing the waiver of a hearing. <br />Sec. 16-41. Disposal of nuisance vehicle. <br />(a) A nuisance vehicle or vehicle part will be disposed of by the city by <br />removal to a scrapyard, demolisher, or any suitable site operated by the city for <br />processing as scrap or salvage, and any reconstruction or work to make the <br />vehicle operable after being removed is prohibited, <br />(b) If the city council determines that commercial channels of disposition <br />are not available or are inadequate, the city may operate its own disposal site <br />and make final disposition of nuisance vehicles or vehicle pàrts at such disposal <br />site, or the city may transfer the vehicles or vehicle parts to another disposal site <br />if the disposal is only as scrap or salvage. <br />Sec. 16-42. Notice to State. <br />The Director of Environmental Health or a designee will give notice to the <br />State Department of Transportation of the removal of a nuisance vehicle not later <br />than 5 days after its removal. The noti~ will identify the vehicle or vehicle part, <br />Sec. '16-43. Authority to enforce. <br />Persons authorized under this division to administer the procedures set forth <br />in this division may enter public or private property for the purposes specified in <br />this division to examine a vehicle or vehicle part, obtain information as to the <br />identity of the vehicle, and remove or cause the removal of a nuisance vehicle <br />or vehicle part. <br />Sec. 16-44. Penalties. <br />(a) Any person who maintains a nuisance vehicle commits a <br />misdemeanor and upon conviction thereof shall be subject to a fine not to <br />exceed $200. Each day a violation continues constitutes a separate offense. <br />(b) Upon conviction, the court ,shall order removal and abatement of the <br />nuisånGe vehicle, if it has not been previously abated, <br />.
