<br /> 193 <br /> STATE OF TEXAS <br /> COUNTY OF CALDWELL <br /> LEASE AGREEMENT <br /> THIS AGREEMENT is made and entered into this 14th day of <br /> February, 1995, by and between CALDWELL COUNTY CHRISTIAN MINISTRIES <br /> ( "CCCM" ), of Caldwell County, Texas, whose address is lP2'S E. ~Vl<) <br /> , Luling, Texas 78648, hereinafter called "Lessor," and the <br /> City of San Marcos WIC Program, whose address is 630 East Hopkins <br /> ! h Street, San Marcos, Texas 78666, hereinafter called "Lessee." <br /> J <br /> I <br /> NOW THEREFORE, in consideration of the rents to be paid and the <br /> mutual convenants to be performed, the parties hereto agree as follows: <br /> 1. DESCRIPTION OF LEASED PREMISES: Lessor leases and demises to <br /> Lessee that real property and improvements situated in Luling, Texas, <br /> with the address of 625 East Davis Street. <br /> . . <br /> 2. TERM: The Lessor agrees, and does hereby, lease the premises to <br /> the Lessee for an original term of one year, beginning on the first day <br /> of February, 1995, and terminating on the last day of January, 1996. <br /> Since the Lessee's fiscal year begins on October 1 and ends on <br /> September 30, if there are no funds appropriated by the Tenant's <br /> governing body for this program for any year that this lease is in <br /> effect, Lessee may terminate this lease with ten (10.) days notice to <br /> the Landlord. <br /> 3. RENEWALS: Lessee shall, by giving written notice to the Lessor on <br /> or before the sixtieth (60th) day prior to the expiration of this <br /> Lease, have the option to renew this Lease for one (1) year at a rental <br /> rate to be agreed upon by the parties hereto and under the same terms <br /> and conditions as stated herein. <br /> 4. HOLDING OVER: If the Lessee remains in possession of the Leased <br /> I Premises after the expiration of this Lease, and without the execution <br /> ¡ of a new Lease, it shall be deemed to þe occupying the Leased Premises <br /> as a tenant from month-to-month, subject to all conditions, provisions, <br /> and obligations of this Lease except that monthly rental shall be <br /> equivalent to one and one-half times the amount of the last monthly <br /> rental payment made by the Lessee prior to the expiration of this <br /> Lease. <br /> 5. RENTAL: Lessee shall pay to Lessor rent at the rate of THREE <br /> HUNDRED and 00/100 Dollars ($300.00) per month for each month during <br /> the term of this Lease. The first month's rent is payable on the first <br /> day of February, 1995. Each subsequent rental payment is due and <br /> payable on the first day of each succeeding month during the original <br /> term of this Lease. A late charge of five percent (5%) on the monthly <br /> rental will be due and payable after the fifteenth (15th) day of the <br /> month if the monthly rental has not been paid. <br /> 6. USE OF THE PREMISES: The Leased Premises shall be used to operate <br /> the WIC Program. The Leased Premises shall not be used for any other <br /> type of activity without the express written consent of the Lessor. <br /> 7. QUIET POSSESSION: The Lessor covenants and warrants that the <br /> Lessee has full right and lawful authority to enter into the Leased <br /> Premises for the full term as provided in this Lease. Lessor further <br /> ,_,-covenants and warrants that the Lessee, upon payment of the rent and <br /> {- performance of all covenants as herein provided, shall peacefully and <br /> quietly have, hold and enjoy the Leased Premises. <br /> 8. UTILITIES: <br /> a. Water, gas and electricity charges accrued during the term of <br /> this Lease Agreement for the Leased Premises are included in the <br /> monthly rental amount paid by the Lessee. <br /> b. Telephone expenses, including installation charges, incurred <br /> by the Lessee will be paid by the Lessee. Any telephone equipment <br />
