<br /> 12ft <br /> -2- <br />the sites, location and description of all lots and a <br />schedule of prices will be kept on file. <br /> (b) Each cemetery lot deed will be issued to only one <br />person. Cemetery lots which have been conveyed by deed may <br />not be subdivided further without the consent of the <br />Cemetery Commission. <br /> (c) Persons desiring to reserve a lot at the cemetery <br />may set up an account in the Finance Department and pay the ! <br />purchase price over an extended period of time according to ' <br />the terms set out in this section. However, the city <br />reserves the right to refuse interment on any lot for which <br />the full purchase price, including perpetual care fees, has <br />not been paid. A deed will not be issued for any lot until <br />the full purchase price, including perpetual care fees, has <br />bee~ ,paid. ., <br /> (d) The price of each cemetery lot and mausoleum crypt <br />is set by separate ordinance. In addition, a perpetual care ,- <br />fee will be charged for each lot and mausoleum crypt in the <br />cemetery, except in the Dixon Addition, Section I. <br />Perpetual care fees are set by separate ordinance on a <br />scale depending on the number of spaces purchas ed at one <br />time. ~ <br /> (e) All deeds will grant to the lot or crypt owner the <br />right to use the lot or crypt for interment of only human <br />remains, subject to the provisions of this chapter. <br /> (f) Persons desiring to pay the purchase price and <br />perpetual care fees over time must enter into an agreement <br />with the city. This agreement will provide that the city <br />will, in the event of default, refund the entire amount ¡ <br />paid by the purchaser, less those amounts paid for which a <br />deed has been issued and l~ss an administrative fee set by <br />separate ordinance. <br /> (g) Upon payment of the entire purchase price plus <br />perpetual care fees for a lot, the city will issue a deed <br />which conveys the cemetery lot to the purchaser. This deed <br />will be recorded in the Deed Records of Hays County, Texas <br />by the city and returned to the purchaser. The purchaser <br />must pay the recording costs to the city at the time of <br />final payment. <br /> (h) When there are 2 or more owners of a lot, then the <br />owners may designate one or more persons to represent the <br />owners regarding the lot and file written notice of the <br />designation with the city. In the absence of such a notice, <br />the city is authorized to permit an interment in a lot at <br />the request or direction of any registered co-owner of the <br />lot. <br />Sec. 6-4. Transfer of lots. <br /> (a) The owner of a cemetery lot may transfer the lot by ¡ <br />a written instrument. I <br /> (b) The transferee must register the transfer of a \ <br /> _- <br />cemetery lot, or interest therein, with the city to be <br />recorded in the books of the city. All transfers of lots <br />will be subject to all provisions of Sec. 6-3 above. The <br />city may refuse to register a transfer if the purchase <br />prlce and perpetual care fees for the transferred lot (s) <br />have not been paid in full. <br />Sec. 6-5.
