77 RESOLUTION 1995- 63 R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING AMENDMENT NO. 1 TO THE REAL ESTATE CONTRACT BETWEEN THE CITY AND SOUTHWEST TEXAS STATE UNIVERSITY¡ AUTHORIZING THE CITY MANAGER TO EXECUTE THE AMENDMENT ON BEHALF OF THE CITY AND DECLARING AN EFFECTIVE DATE. -- RECITALS: 1. In July 1993, the City of San Marcos submitted a grant application to the Texas Parks and Wildlife Department (TPWD) for the acquisition and development of the Rio Vista property. 2. The TPWD grant requires that the project include water recreation improvements, and the City fulfilled this requirement by proposing improvements to the Rio Vista Dam. 3. TPWD has reviewed the City's grant application and determined that the City will qualify for the grant once it receives clearance from the U.S. Corps 'of Engineers and the U.S. Fish and Wildlife Services~ Clearance is required because the site contains wildlife designated as endangered species. 4. Because project review may take up to 12 months to complete, the City will not receive clearance for the project in time to complete the purchase of the property from the Southwest Texas State University Support Foundation by the current March 30th deadline. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: PART 1. That Amendment No. 1 to the Real Estate Contract between the City and Southwest Texas State University Support Foundation, a copy of which is attached to and incorporated in this Resolution for all intents and purposes, is approved. PART 2. That the City Manager, Larry D. Gilley, is authorized to execute the Amendment on behalf of the City. PART 3.
