<br /> 104 <br /> RESOLUTION 1995- 74 R <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br /> SAN MARCOS, TEXAS f AUTHORIZING THE CITY <br /> MANAGER TO SUBMIT AN APPLICATION TO THE TEXAS <br /> NATURAL RESOURCE CONSERVATION COMMISSION <br /> FOR A PERMIT TO DIVERT, STORE AND USE SURFACE <br /> WATER; AUTHORIZING ACTION IN SUPPORT OF THE <br /> APPLICATION; AND DECLARING AN EFFECTIVE DATE. <br /> RECITALS: <br /> 1. The City Council has determined the need to diversify the City's water <br /> supply so that the City does not depend entirely on the Edwards Aquifer as its sole <br /> source of water. <br /> 2. The citizens of San Marcos have given approval to an $8.5 Million bond <br /> proposal for the development of alternative water supplies. <br /> 3. The City Council wishes to begin and pursue the state administrative <br /> processes necessary for the City to secure rights to surface water to serve as an <br /> alternative water supply. <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS. <br /> TEXAS: <br /> . <br /> PART 1. That the City Manager, Larry D. Gilley, is authorized to sign and submit <br /> an application to the Texas Natural Resources Conservation Commission (TNRCC) for <br /> a permit to divert, store, and use surface water. <br /> Part 2. That the Director of Public Works is authorized and directed, on behalf of <br /> the City, to appear and arrange for the appearances of persons representing the City <br /> at the hearings and other proceedings on the application before the TNRCC, and to <br /> otherwise direct prosecution of the application on behalf of the City. <br /> Part 3.
