<br /> 23 <br /> RESOLUTION 1995- 89 R <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br /> SAN MARCOS, TEXAS, OPPOSING THE CREATION OF <br /> THE SOUTHWEST TRAVIS COUNTY WATER DISTRICT BY <br /> THE STATE LEGISLATURE; AND DECLARING AN <br /> EFFECTIVE DATE, <br />RECITALS: <br />! ¡ <br /> ; <br />1. H. B. 3193, introduced in the 74th Texas Legislature to create the North Hays <br />County Water Authority, has been amended to propose the creation of the Southw~st <br />Travis County Water District (STCWD). ¡ <br />2. HB. 3193 would establish an unhealthy precedent in an area adjacent to Hays <br />County by depriving elected local governments of the ability to regulate the development <br />of properties within and adjacent to their boundaries. <br />3. H.B. 3193 would single out a small segment of the area of the Barton Springs <br />Edwards Aquifer Conservation District for different treatment in the use of groundwater than <br />the remaining territory in that district. <br />4. H.B. 3193 would relegate control over development to an unhecessary new layer <br />of government, overseen by officials appointed without local election or direct input. I <br /> ¡ <br />5. H.B. 3193 would provide the STCWD not only with the ability to provide water <br />and wastewater utility services, but also with the authority to regulate subdivision platting, <br />zoning and land use, powers otherwise provided in Texas only to incorporated <br />municipalities with elected governing bodies, <br />6. The effect of H,B. 3193 would be to undermine the authority of existing locally <br />elected governmental bodies, <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS. <br />TEXAS: <br />PART 1. That the City of San Marcos opposes H,B. 3193. <br /> <br />PART 2. That the City of San Marcos officially requests that its representatives in <br />the legislature oppose this bill. <br />PART 3.
