DENSITY) AND "C" COMMERCIAL DISTRICT TO "C" ¡ COMMERCIAL DISTRICT AND DECLARING AN EFFECTIVE DATE. RECITALS: 1. On Apr:il 11, 1995, the Planning and Zoning Commission of the City of San Marcos held a public hearing regarding a request to change the zoning from "MF-4" Multi- Family District (High Density) and "C" Commercial District to "C" Commercial District for an 18.137 acre tract of property located in the 1400 Block of River Road. 2. Subsequent to the public hearing on that date, the Planning and Zoning Commission did, on April 11, 1995, consider and vote to approve the request, and has recommended that the request be approved by the City Council of tl'1e City. 3. The City Council held a public hearing on the 22nd day of May , 1995, regarding the request. 4. All requirements of Appendix A, General Zoning Ordinance, of the Code of Ordinances of the City of San Marcos pertaining to amendments have been met. 5. The City Council finds and determines that the adoption of the following ordinance is in the interest of the public health, f}1orals, welfare and safety. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. That the Official Zoning Map of the City, as described in Section 3 of the General Zoning Ordinance, is amended to rezone the following real property which is presently zoned "MF-4" Multi-Family District (High Density) and "C" Commercial District to "C" Commercial District: Street address: 1400 Block of River Road Size: 18.137 acres. Legal description: See attached Exhibit "A". Deed or plat reference: Volume 829, page 578 of the Deed Records for Hays County, Texas. SECTION 2. That this Ordinance shall be in effect ten (10) days from and after its ¡ passage and after it has been subject to reconsideration by the Council at its next regular , meeting following its passage, and provided that the Council did not vote to reconsider it. If reconsidered on June 12, 1995, it shall be in effect ten days from and ._~ after its passage on that date if approved. It shall not go into effect if denied. If not reconsidered and approved it shall be published in a newspaper of general circulation in the area as required by the Charter of the City of San Marcos, Texas. PASSED, APPROVED AND ADOPTED this 22 day of May ,1995, subject to reconsideration at the next regular City Council meeting scheduled for June 12, 199.5.
