L- -13- ARTICLE 13 BASIS OF COMPENSATION The CITY will compensate the ENGINEER, in accordance with Article 5, Payments to the ENGINEER, and the other terms and conditions of this Agreement, as follows: 13.1 BASIC COMPENSATION 13.1.1 For Phases 1 and 2 of the Project as described in Sections - 1.1 1.2, the ENGINEER will be compensated according to the actual - number of hours spent on the proj ect billed at the standard hourly rates listed in subsection 13.2.1, and total compensation for these phases will not exceed $17,000.00. 13.1.2 For Phases 3 through 6 of the Project as described in Sections 1.3-1.6, the ENGINEER will be compensated in an amount equal to 10% of the construction cost of the proj ect, determined in the following order:öf precedence: (a) For completed work, the actual total cost to the CITY of such work. (b) For work designed but not constructed, the lowest bona fide bid received from a qualified bidder for such work. ,¡ (c) For work designed but not bid, the most recent opinion of the ENGINEER of the cost of such work. Payments to the ENGINEER will be made as provided in Section 5.1 so that compensation for each part of these services equals the following portion of the ENGINEER's compensation for these phases: phase 3 Preliminary Design 25% Phase 4 Final Design and Document Preparation 45% Phase 5 Bidding 10% Phase 6 Construction Administration 20% The total of the fees paid to ENGINEER for these phases will not exceed $20,000. 13 - 2 COMPENSATION FOR ADDITIONAL SERVICES. 13.2.1 For additional services of the ENGINEER as described in Section 1.7, Compensation will be computed as follows: PRINCIPALS James E.
