<br />- ~ 76 <br />. <br />.. <br /> AMENDMENT NO. 1 <br /> PROFESSIONAL SERVICES AGREEMENT <br /> HDR ENGINEERING, INC. <br />STATE OF TEXAS <br />COUNTY OF HAYS <br /> The City of San Marcos and HDR Engineering, Inc. agree <br />to amend their original agreement for engineering services in <br />connection with a comprehensive engineering study of surface <br />water supply for the City of San Marcos municipal water <br />system, dated June 9, 1992. <br /> 1. Subsection 1.1.1 is amended to read as follows: <br /> 1.1.1 In the performance of all engineering services <br />in connection with this Agreement, the ENGINEER shall use <br />that degree of care and skill ordinarily exercised for <br />similar projects by professional engineers who possess <br />special expertise in the type of work involved in this <br />Project. ENGINEER may engage subconsultants to perform work <br />on the Project with the prior written approval of the CITY. <br />ENGINEER will be responsible for all work performed by its <br />subconsultants. <br /> 2. The following additional services of ENGINEER are <br /> approved by the CITY: <br /> (a) ENGINEER will perform an environmental and cultural <br />resource study through the use of Paul Price Associates, Inc. <br />as a subconsultant in accordance with the proposal dated <br />Ap r i 1 4, 1995 submitted by this subconsultant to the <br />ENGINEER. <br /> (b) ENGINEER will be compensated for the <br />performance of these additional services in an amount not to <br />exceed $102,649.00 including reimburseables, based on the <br />subconsultant's Standard Rate Schedule and not including any <br />additional amounts (e.g., multiplier or percentage added) for <br />the ENGINEER '"s provision of those services through a <br />subconsultant. <br /> 3. The parties agree that all other terms and <br />conditions of the original agreement shall remain in full <br />force and effect for the duration of the Agreement. <br /> By the signing of this amendment, the parties expressly <br />understand and agree that this amendment will become a part <br /> -1- <br />
