The Department <br /> may allow full credit to the Participant for the State share of the noncancellablè obl igations, <br /> properly incurred by the Participant pin writing of the determination and th~ reasons for termination, <br /> together with the effective date. Payments made to the Participan~ or recoveries by the Department <br /> under projects terminated for cause shall be in accord with the legal rights and'liabilities of the <br /> parties. <br /> 5. Termination either for cause or for conveniènce requires that the project in question be brought tò a <br /> state of recreational usefulness agreed upon by the Participant and the Director, or that all funds <br /> provided by the Department be returned. <br />J. Section 504 Guidelines for Assisted Park and Recreation Programs and Activities <br /> . <br /> Pursuant to the Department of Interior Office of Equal Opportunity Section 504 Guidelines (43 CFR 17, <br /> Subpart B), the following are required of all grant Participants: <br /> 1. Assurances - Participants are required to provide written assurance that their programs are to be <br /> operated in compliance with 43 CFR 17, Subpart B. <br /> 2. Self-evaluation - All Participants are required to evaluate their programs, activities, policies and <br /> practices to determine what actions need to be taken in order to comply with Section 504. This self <br /> evaluation process must include interested persons, including handicapped persons or organizations <br /> representing handicapped persons. If the Participant employs 15 or more full or part-time employees, <br /> a copy must remain on file and available for public inspection for 3 years after it is completed. The <br /> self evaluation "must indicate the areas examined, problems identified and the remedial steps the <br /> recipient will take to eliminate discriminatory policies and practices toward handicapped persons. <br /> 3. Every Participant that employs 15 or more persons full or part-time must designate at least 1 person <br /> the responsibility for ensuring Section 504 Compliance. <br /> 4. Each Participant that employs 15 or more persons full or part-time must adopt grievance procedures that <br /> provJde for the prompt and equitable resolution of complaints alleging discrimination on the'basis or <br /> handicap. { <br /> 5. Each Participant must proclaim to the public its policy of nondiscrimination and the procedures for <br /> filing complaints. This requirement can be met through the use of program publications and/or the <br /> Department's nondiscrimination poster which Covers all of the required Federal anti-discrimination <br /> provisions. Each Participant must explain to an individual who feels he or she has been discriminated <br /> against or desires further i nformat i on that the person wri te to the Di rector, Office for Equa 1 <br /> Opportunity, Department of the Interior, Washington, D.C. 20240. <br /> 6. Each Participant that employs 15 or mare persons full or part-time must take initial and continuing <br /> steps to notify program Participants, beneficiaries, applicants, and employees. including persons with <br /> impaired vision and hearing, that they do not discriminate on the basis of handicap. <br /> 7. In instances where structural changes to facilities are necessary to achieve program accessibility, <br /> each Pa rt i c i pant sha 11 develop a transition plan' setting forth steps necessary to complete such <br /> changes. <br />I have read the General Provisions and understand that the 1 oca 1 sponsor <br />(IIParticipant") which I represent will be responsible for compliance with the <br />above as a result of the recei pt of grant assi stance from the Texas Local .Parks, <br />Recreation 'and Open Space Fund.
