<br />Operatina Procedures and Reaulations and the Minimum Standards for Fixed Base <br />Operators and Airport Tenants, as they now exist or may be amended during the term of <br />this Lease, and any conflict between this Lease and these procedures, regulations and <br />standards will be resolved in favor of the procedures, regulations and standards. <br /> <br />Article 2. Rent/Term <br /> <br />2.01. Rental shall accrue from the commencement date of this Lease, and shall be <br />payable at the place designated for the delivery of notices to the City in paragraph 15.12. <br /> <br />2.02. The Lessee agrees to pay to the City a fixed rental in the sum of $0.20 per square <br />foot per year for the entire area of the Leased Premises. The annual amount for the fixed <br />rental shall be paid in equal quarterly installments in the amount of $ 1000.00 which shall <br />be due and payable on the last day of the last month for the current quarter. <br /> <br />2.03. The Lessee agrees to pay to the City a fixed rental in the sum of $100.00 per Fuel <br />Storage Tank for a total of $200.00 a year. First payment is to be made within 30 days of <br />the commencement of the Lease as defined by paragraph 2.12. Subsequent payments <br />shall be due within 30 days of the anniversary of the commencement date of the lease. <br /> <br />2.04. As further consideration, the Lessee agrees to pay to the City a percentage rental in <br />the form of a monthly fee equal to one percent of the Lessee's gross income from all of the <br />Lessee's commercial activity at the Leased Premises. This excludes sales or services to <br />federal, state or local governments or other tax exempt organizations or agencies. <br />Payment is to be made within ten days of the last day of the previous month and shall be <br />based on the Lessee's income during the previous month. <br /> <br />2.05 As further consideration, the Lessee agrees to pay to the City a percentage rental in <br />the form of a fuel flowage fee in the amount of 40/0 of the cost of all aviation fuel or gasoline <br />delivered to Lessee. Payment is to be made within ten days of the last day of the last <br />month of the previous quarter and shall be based deliveries received by Lessee during the <br />previous quarter. <br /> <br />2.06. The City agrees to accept as advance payment of fixed rental due pursuant to <br />paragraph 2.02 the agreed cost of the public taxiway and public parking lots to be <br />constructed pursuant to paragraph 5.04 A and B. If the Lease is terminated for any reason <br />during the term of advance payments pursuant to this paragraph Lessee is not entitled to <br />any reimbursement. The cost of the public restroom and waiting room to be constructed <br />pursuant to 5.04 C are not eligible for use as advanced payment. <br /> <br />2.07 If the agreed costs pursuant to paragraph 5.04 A and B exceed the total of the Fixed <br />Rental payments due pursuant to paragraph 2.02 and 2.03 for the entire initial term of this <br />Lease the excess agreed costs shall be credited towards the rentals due pursuant to <br />paragraphs 2.04 and 2.05.
