<br />dispensing purposes and for no other purposes without the advance written consent of the <br />City. The Lessee shall use the Fuel Storage Tanks in good faith continuously for this <br />purpose throughout the term of this Lease. The Lessee shall not leave the Fuel Storage <br />Tanks vacant at any time. The following requirements apply to the Fuel Storage Tanks: <br /> <br />A. The Lessee is responsible for relocating the Fuel Storage Tanks to the <br />location approved by the Fire Marshall. Lessee shall be responsible for all make ready <br />expenses including refurbishing the Fuel Storage Tanks and appropriate permitting and <br />inspections. The tank, pumps and dispensing equipment shall be mounted on a concrete <br />slab, and the fuel island and canopy constructed pursuant to all applicable Fire, and <br />Building Code and FAA requirements and restrictions, including but not limited to a fuel spill <br />containment system. <br /> <br />B. Lessee shall dispense only Jet-A and 100 LL fuel from the Fuel Storage <br />Tanks and automated fuel dispensing facility to individual aircraft. During all hours of <br />operation of the automated fuel dispensing facility, the Lessee will ensure that the minimum <br />Fixed Base Operator standards for on site personnel will be met or exceeded. <br /> <br />C. Upon any termination of the Lease, either by the expiration of the term of the <br />lease or by default, the fuel dispensing premises and all associated improvements shall <br />revert to City and at City's option Lessee shall remove any improvements and return Airport <br />premises to original condition. <br /> <br />3.03. The Lessee shall not place or keep anything on the Leased Premises or use the <br />Leased Premises for any purpose which increases the insurance premium cost or <br />invalidates any insurance policy carried on the Leased Premises without the City's prior <br />written consent. The Lessee agrees that the risk of loss and damage for all property kept, <br />stored or maintained by it within the Leased Premises shall be the Lessee's. <br /> <br />3.04. The Lessee shall not use or permit the use of the Leased Premises in any manner <br />that results in waste of the Leased Premises, or constitutes a nuisance, or violates any <br />statute, ordinance, rule or regulation that applies to the Leased Premises. <br /> <br />3.05. The Lessee shall keep the Leased Premises, including ramps, signs, sidewalks, <br />service ways, and loading areas adjacent to the Leased Premises, neat, clean, and free <br />from dirt and trash at all times. The Lessee shall provide containers for all trash on the <br />Leased Premises, and shall arrange for the regular removal of the trash at the Lessee's <br />expense. <br /> <br />3.06. The Lessee shall store all equipment, materials and supplies within the confines of <br />the building located on the Leased Premises. Outside storage is specifically prohibited <br />without the advance written consent of the City. <br /> <br />3.07. The City agrees that the Lessee shall have access to the runways, taxiways and <br />ramps at the Airport to the same extent as other Airport users. The City's failure to <br />
