The Crty is also authorized to reimburse the <br />appropriate City funds for such payment from proceeds of the Bonds <br />Section 14 04 Severabilrty <br />If any section, article, paragraph, sentence, clause, phrase or word m this Ordinance, or application <br />thereof to any person or circumstance is held to be mvahd or unenforceable ,the remainder of this Ordinance <br />and the application of such section, article, paragraph, sentence, clause, phrase or word to other persons and <br />circumstances nevertheless shall be valid and enforceable, and it is hereby declared that this Ordinance would <br />have been enacted without such mvahd or unenforceable provision. <br />Section 14 OS No Personal Liability <br />No covenant or agreement contained m the Bonds, this Ordinance or any corollary instrument shall <br />be deemed to be the covenant or agreement of any member of the Crty Council or any officer, agent, employee <br />or representative of the Crty Council m his or her individual capacity, and neither the directors, officers, agents, <br />employees or representatives ofthe City Council nor any person executing the Bonds shall be personally liable <br />thereon or be subject to any personal liability for damages or otherwise or accountability by reason of the <br />issuance thereof, or any actions taken or duties performed, whether by virtue of any constrtut~on, statute or rule <br />of law, or by the enforcement of any assessment or penalty, or otherwise, all such liability being expressly <br />released and waived as a condition of and m consideration for the issuance of the Bonds <br />San Mazcos GO 2007 Ordinance 3 6 <br />
