33~ Sectian 3.09. Replacement Bands. (a) Upan the presentatian and surrender to. the Paying Agent/Registrar, at the Designated Payment/Transfer Office, af a mutilated Band, the Paying AgentlRegistrar shall authenticate and deliver in exchange therefar a replacement Band aflike tenar and principal amaunt, bearing a number not cantemparaneausly autstanding. The City or the Paying Agent/ Registrar may require the Owner af such Band to. pay a sum sufficient to. caver any tax ar ather gavernmental charge that is authorized to. be imposed in cannectian therewith and any ather expenses cannected herewith. (b) In the event that any Band is last, apparently destrayed ar wrongfully taken, the Paying Agent/Registrar, pursuant to the applicable laws of the State of Texas and in the absence of notice ar knawledge that such Band has been acquired by a bona fide purchaser, shall authenticate and deliver a replacement Band of like tenar and principal amaunt, bearing a number not cantemparaneausly outstanding, provided that the Owner first: (i) furnishes to. the Paying AgentlRegistrar satisfactory evidence of his or her awnership af and the circumstances of the lass, destructian or theft of such Bond; (ii) furnishes such security or indemnity as may be required by th~ Paying AgentlRegistrar and the City to save them harmless; (iii) pays all expenses and charges in cannection therewith, including, but not limited to., printing. costs, legal fees, fees af the Paying AgentlRegistrar and any tax or other governmental charge that is authorized to be impased; and (iv) satisfies any other reasonable requirements impased by the City and the Paying Agent/Registrar. (c) If, after the delivery of such replacement Bond, a bana fide purchaser of the original Band in lieu of which such replacement Band was issued presents far payment such original Bond, the City and the Paying Agent/Registrar shall be entitled to recover such replacement Bond from the persan to. wham it was delivered or any person taking therefram, except a bona fide purchaser, and shall be entitled to. recover upon the security or indemnity provided therefor to. the extent of any lass, damage, cost ar expense incurred by the City or the Paying Agent/Registrar in connection therewith. (d) In the event that any such mutilated, lost, apparently destroyed or wrongfully taken Band has became ar is about to. become due and payable, the Paying Agent/Registrar, in its discretian, instead af issuing a replacement Band, may pay such Band.
