ORDINANCE NO. 2012 - 46 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS DELETING THE POLICE DEPARTMENT <br />ASSIGNMENT PAY PROVISIONS CONTAINED IN CHAPTER 62, <br />ARTICLE 2, DIVISION 2 OF THE SAN MARCOS CITY CODE <br />DUE TO THE ADOPTION OF A MEET AND CONFER <br />AGREEEMENT WITH THE SAN MARCOS POLICE OFFICERS <br />ASSOCIATION THAT PROVIDES FOR ASSIGNMENT PAY; <br />INCLUDING PROCEDURAL PROVISIONS; AND DECLARING <br />AN EFFECTIVE DATE. <br />Recitals: <br />1. On September 18, 2012 the San Marcos City Council approved a meet and <br />confer agreement with the San Marcos Police Officers Association that <br />provides for the payment of assignment pay for certain specialized functions <br />performed by sworn personnel in the San Marcos Police Department. The <br />meet and confer agreement became effective on October 1, 2012. <br />2. It is no longer necessary to provide for police assignment pay in the <br />San Marcos City Code. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS: <br />SECTION 1. Division 2 - Special Assignment Services, of Article 2 - Police <br />Department, of Chapter 62 - Public Safety of the San Marcos City Code is hereby <br />repealed. This repeal includes Section 62.056 — Purposes, Section 62.092 - Assignments, <br />and Section 62.093 — Compensation. <br />SECTION 2. If any word, phrase, clause, sentence, or paragraph of this <br />ordinance is held to be unconstitutional or invalid by a court of competent jurisdiction, <br />the other provisions of this Ordinance will continue in force if they can be given effect <br />without the invalid portion. <br />SECTION 3. All ordinances and resolutions or parts of ordinances or resolutions <br />in conflict with this Ordinance are repealed. <br />SECTION 4. This Ordinance shall be effective upon its adoption on second <br />reading. <br />PASSED AND APPROVED on first reading on October 1, 2012 <br />PASSED, APPROVED, AND ADOPTED on second reading on October 16, 2012. <br />
